Fresh(6yrs) H1B visa eligibility???

Hi!

I have the following question:

If a person has to go back to India without completing the "H1-6yrs limit", then does he/she needs to wait till the end of the "H1-6yrs limit" plus an additional 1 yr to come to US on a fresh(6yrs) H1B visa?

For example:
Is a person eligible for fresh 6 year new H1 on Apr 2005, eventhough by Apr 2004 the person uses only 5 years of his/her current H1B's 6 years?

Yes if person leave USA by April 2004 and comes back after April 2005 - gets fresh 6 years. Just ask to get your H1b cancelled in that case.
