Fraudulently revoked my H1B still I haven’t received any notice

Hello All!

My sister in law did her small projects (3 – 4 months long) in 2003 and 2005 and she went back. This time she was on H1B since 2008 with one of the reputed company and she was on bench and on 30 March fraudulently her employer inform INS that she left a job. I came to know this from my network in HR Dept of hers company . What’s the option she does have? She hasn’t received any notice from INS. When will she be out of status? Does she convert her H1B into B1 visa to maintain the legal status?

I would highly appreciate response back.
 
She was out of status as soon as she was not paid. Her company terminated her. It was entirely legal as they had no work for her. There is no way fer her to get back into status without leaving the US. She can find a new employer to file a new petition not under cap so she can reenter.

The longer she stays out of status, the worse it looks for her. She needs to leave.
