Hi all,

My case was transferred to local office late last year. I recieved FP notices for my wife and myself. THe only problem is that I am required to do my FPs one day before my wife. Anybody have this experience? Should nlt these people have consideration and do the FPs for my wife and myself on the same day given we have to drive 200 mi to do the FPs?

Two more questions please does this mean that the officer handling our case is a mean person given that he did not schedule our FPs on the same day instead of splitting it into two days or am I reading too much into it? are the FPs notices sent by the officer handling our case or are they sent by the office?

Thanks,
Spartakus

I wouldn't worry to much about it

spartakus,

I don't think there is any logic in the way things are done at any of the BCIS offices. I am also not sure whether the notice is sent by an officer or the office itself. Just be glad that they sent the FPs to you. I have been screwed over by them several times so whenever some positive action is taken on my case I try to cheer up a bit.

Good luck.

I forgot to mention that you should take your wife along with you when you go for your FP. Try to reason with them and they may let her take the FP with you. The only down side is that your wife might have to take some time of work for a couple of days (if they do not take her FP) but its worth trying. Any reasonable human being should allow her to take the FP with you.

Hello Saras76,

My case was transferred to Buffalo on November 5, 2004. I have not heard anything yet. I am starting to get a little concerned that my case is lost in transition like yours. What do you think is the best course of action for me?

1) Make an infopass appointment and go to Buffalo
2) Call the local senetor's office and ask them to inquire about it.

Please help.

Huifang,

It appears that both our cases were transferred to local offices by mistake. My case sat in Miami for 4 months before I raised hell with my lawyers and got them to start an inquiry through AILA (American Immigration Lawyers Association). AILA has a liasion within the TSC that responds and acts on inquires that are sent his/her way by AILA. My lawyer sent a couple of inquiries through AILA and in November she got an email from someone in AILA that my case is being recalled to Texas. I did not get any official notification of this recall (infact the online status still says that the cases were transferred to Miami on the 16th of July) but on the 9th of Dec 04 the LUD on my approved AP changed for a couple of days and then finally on the 3rd of Jan I received FP notices from TSC. This leads me to believe that my case is back at TSC and they are now processing it. The delay caused by the transfer has added more time to this stupid process. I have also gotten authorization from my company to start a congressional inquiry into my case if nothing happens after FP. The bottom line is that I still have no idea where my case is. Everything is an assumption.

I suggest you do the following -

1. Ask your lawyer to start an AILA inquiry. They should know how to do that.

2. Try to convince your company to start a congressional inquiry and if they are unwilling to do so then you write a personal letter to the Congressman in your area. You can refer to my case as an example of how these people are making so many errors. In the letter emphasize that you feel that the case is in the wrong district, that 140s are not supposed to be transferred to local offices and that no one is giving you any updates on the location and status of your case.

I am pretty sure your case should not be where it is. Even if it was sent there for a reason, TSC should let you know why. The inquires should answer those questions. I hope your case gets back to TSC.

Good luck and feel free to send me a personal message if you need more information.

Went to the application support center

Hi all,

Thanks all for all teh responses.

I went today to the application support center sicne I went to INS to get my interim EAD. I asked them to take our finger prints today but there were 60 people in front of us so the guy said that he can not get to us today since it was almost 2:30 and they close at 4 pm. He wrote on my FP notice the date of my wife's FP date so that we can do it on the same day in two weeks.

Thanks,
Spartakus

Where did you file for EAD renewal after transfer

Hi spartakus

Where did you file for your EAD renewal after transfer to Charlotte office? Did you file at Service Center or the Charlotte office?

Thanks

My EAD filing

Hi Chaudhary-Sahib,

It is a long story. My lawyer filed for me at Charlotte but Charlotte sent it to TSC in error then TSC sent it to Charlotte and again Charlotte sent it back to TSC and finally it was sent to Charlotte and stayed there. It caused me a great deal of discomfort and I did not recieve any receipt and the checks were not cached for two months so I was running against time, luckily I applied long time back so I had some time left before the expiry of my current EAD to get it renewed. So my advice to everybody APPLY AT LEAST 6 MONTHS before the expiry date of your EAD.

Thanks,

Finger Prints

Went yestrday and did finger prints for me and my wife. We are waiting on response now after that. Hopefully they approve our cases now or call us for an interview. I am not sure how long does it take for the finger prints to clear though, anybody has an idea or input?

Thanks,
Spartakus
