I did my FP in april 2002 & MINE IS NOV 01 CASE ,As my fp is expired by now there is no chance of me getting my case approved with out a 2nd fp but I get no correspondence from bcis neither for 2nd fp nor for any RFE ........I called NCSC they sent a letter stating my case is in normal time frame & tried senator no response .......Iam wondering if there is any other way to get notice from BCIS for a 2nd FP .........any advise?
 
look at Rajiv's petition draft, it seems 2nd FP no longer expires after 15 months. I have posted a
reply, asking him to explain the new policy.

we have seen several cases approved without 2nd fp, so maybe the policy changed in July.
 
Is this really true ?????

I am waiting for my 2nd FP for (Now 17 months have passed).

Where can I find the new rule for 2nd FP ?

Really, I had my FP1 done on 10th April (BCIS received), no rfe no FP2 no nothing. Called up NCSC they said it is within the normal processing time, refused to even send a query. Sick and tired of checking the same message over and over again

I don't know if it's true. It appears in Rajiv's petition. But I can't find such memo online, rather I found "strict enforcement of fingerprint expiration" on various websites. I don't know if it's a mistake or it's new policy.

The fingerprint is valid for 15 months, but beginning sometime back, the Service Centers started sending out re-fingerprint notices to the I-485 waiters even if they took the print only a few months back. A large number of people complied with the refingerprint notices and took another fingerprint, because people assumed that it was not errors but probably related to security clearance needs. Now, all of sudden, people start receiving one or two sentence notice from the BCIS that the fingerprint was taken in their cases less than 13 months and BCIS was cancelling the refingerprint notices. Until the motive of such change of practice is made available, one can only guess its implication. One implication can be that the BCIS may adjudicate such 485 cases before the fingerprint expires in 15 months. Readers, this is just a wild guess of this reporter with no reliable sources of information. Let's cross our fingers, and wait and see!
 
I think the only time when someone gets approved without the 2nd FP is when the officer starts working on the case before the 1st one expires. The fingerprint results are physically deleted from the FBI database after 15 months if unrequested so it is not a matter of choice for the officer, but a necessity -he needs your FP for the GC card.
Otherwise none of us would have gotten the 2nd notices and most of us do get them on time (15-16 months later).
1st FP 4/11/02
2nd FP 8/15/03 - 16 months
 
but why RFE cases get 2nd FP if your theory is right.

The only case I can think of is the case is approved, sitting there waiting for security check/director signature. After the security check is passed, the case is approved.

Or, VSC forgot an approved case, and later found it somewhere, and sent out the notice.
 
Same here. First FP was done in April 02. Asked my lawyer whats going on with FP experiation on last week of July. She told me BCIS didn't generate any second FP on my case yet. If BCIS thinks it's necesary they will let us know. It appears that, this 2nd FP waiting is more killing than GC waiting. :o :mad: :eek:

Specially when you know that 2nd FP can not be avoided and till officer take a look at case, it would't get generated :(

Well, its 17 + months before 1st FP still no sign of 2nd one...

I think the fingerprints results are pulled from the database at the approval stage and the RFEs are generated earlier, so if FPs expire between RFE and approval you get the second FP notice.
