FP validity question

Of late I've been hearing a lot about approvals related to the 15 month validity of FP. I have a question regarding the validity:

The 15 month period starts from the date of the actual FP or from the date BCIS received the FP review from FBI?

For example, in my case the actual date of FP was 4/27/2002 but the FP review was received by BCIS on 5/6/2002. This is slightly more than a week and may not be of much relevance, but there might be cases where the time diff is a few months.

I too have been reading all these kind of posts on this forum. Hence, I was curious to know if this rule actually exists in the first place, I thought my lawyer would be the best person to answer. This is her reply to my question.

Once your fingerprints are completed, there is no expiration. In other words, BCIS won't request these from you again because your first fingerprints expired.

I filed my 485 in March 02 and had my and my wife's finger prints done in April 02. I was just wondering if there is any rule of the finger prints getting expired after 15 months if the 485 is still not approved. If it exists, what exactly is the rule like when does the 15 month period start and what is it I need to do on
my end ?.

It is true that there is no logic in saying that fingerprints expired, because fingerprints remain same all life unless altered artificially.

It is the clearance report based on FP that expires. BCIS' reasoning is that, maximum time span an immigrant will spend without committing any crime is 15 months. Hence the need to check criminal records, based on FPs, every 15 months.

There is a detailed explanation of this on Murthy's site. I could not find the link but if you navigate her site, you certainly can.

In this forum I remember seeing messages from members who received notices for second FPing.

Those persons who really went for 2nd FP after 15 months, could you please share your experience.

I got a notice for the 2nd FP from BCIS, The notice is dated exactly 15 months from the date my 1st FP was received. 1st FP was received on 01/31/02 and 2nd FP notice date is 05/01/03. The notice clearly says that the Fingerprints have expired and have to be redone to continue processing on the case.

With all due respect, perhaps you should get a new attorney.....and consider apologizing to the posters who posted accurate information re the FP expiration.

2nd FP is needed after 15 months

I believe 2nd FP is need after 15 months. The reasonable explanation is after 15 months, the FP record will be purged from BSIC system. Altho there may be concerns for people to commit a crime within 15 months after the 1st FP, but in reality, who will risk loosing the GC expecially we are highly educted hard workers!!!:D :D :D gb

Actually your fingerprints won't expire. The process is INS requests report for your fingerprints from FBI. BCIS stores this report for 15 months. After 15 months there is no way to ask FBI to give the update on the report(meaning latest report) because both BCIS and FBI won't store the image of the fingerprints. So they have to get the fingerprints again to obtain FBI report.
