FP redo for spouse; I485 pending !

Hi folks,

Just to recap our details: EB2(RIR) - India - PD Dec97 - RD Jun99 - ND Jul99 - FP Jun00 - my case approved on 08/14/00.

My wife called up VSC today to inquire about her case. She was told that she will have to redo her FPs as they "could not be read" - whatever that means. The IIO was surprised that we did not know about this. She (IIO) suggested that we should contact our lawyer and find out whether they have received the FP redo notice - if not then have the lawyer contact INS (I guess to re-issue the notice). My lawyer says that they have not received any FP notice and unfortunately I am not sure when the notice was mailed. In any case I have no idea why they had to wait for more than 2 months (first FP date 06/15/00) to let us know that her FPs were unacceptable. I had called up FBI a week after doing the FP and was told that they had been successfully transferred to the INS.

My questions are:
Did anyone have a similar experience ?
Do you recommend just waiting patiently for the FP notice to show up or call an IIO again for more details?
Lastly, after the FP is re-done, any idea which queue this case will be thrown in ? in short how long for approval ?

Any information/recommendations will be highly appreciated. Thanks in advance.

sorry to hear about this. are you sure your wife\'s fp was approved the first time. in my case i was told in the first time that the fp was not classifiable. if fbi simply mentioned that they transferred the case to ins, it does not mean that it was approved.
why don\'t you call fbi again and ask if they approved the fp. if not classifiable, then you have a problem- similar to my wife\'s case.

Thanks for the suggestion Q104. Could you please explain what is meant by "not classifiable"? Is this the same as "FPs not done correctly" or is it more serious ? And what is the correct question to pose to the FBI officer then ? If I ask "Were my wife\'s FPs APPROVED", is this sufficient ?

Not classifiable means that the quality of the FP is poor & FBI is not able to read it. The FP could have been done correctly but the net result is that they cannot decipher it. This is a problem with some ladies\' hands. Ask the FBI whether the quality was OK & whether it was approved. In my case they said that my fp & my daughter\'s was OK, but wif was unclassifiable. They also said that she will have to redo the FP. The bad news is that once it is poor quality, even in re-do it will turn out to be same- after all the hands are not gonna change. So the whole thing is a big farce.
Anyway since your name is NOfear, you have nothing to worry. Hope for the best & let me know after you call up FBI>

I called up FBI; since their computers are down I was asked to call up tomorrow. In the meanwhile, with the "fear" of beating this issue to death, can you tell me what the solution is here? As far as I remember your wife\'s FPs were rejected twice and then the case was transferred to the local INS office for an interview (please fill me in, if this is incorrect). Assuming that her case was transferred solely due to FP problems, how will the transfer to local INS help ? Do you know what to expect next ? As you said this is a total farce. Can they actually deny a dependent\'s application based on this issue ? Any input from your lawyer ?

Sorry for the multiple questions - I am just trying to look at all possble scenarios.

You are as anxious as I am & your questions are well founded. I had the same queries. My wife\'s case is as you mentioned. My lawyer also mentioned that transferring the case to newark, is not going to solve the fp problem. When my lawyer called the VSC, they were not sure whether the transfer was due to fp or not. It appears it may be just an excuse to clear their own tables( as per the trend on the board these days a number of spouse\' case is either transferred or deferred).
You need not worry about denying an application( in fact my wife had the same fear). There has never been a case of denial( at least from what I\'ve heard & read on the boards). If that was so, then they would have sent an RFE or an "intent to deny" notice- which anyway ultimately gets approved.I guess it ia all a matter of time & getting an interview date. Newark is very bad as I have not known even a single person who has been interviewed. Incidentally which is your local INS office?
Hopefully she may get approved without all these hassles- so keep your fingers crossed & pray tonite before going to bed.
