FP notice mailed to wrong address...missed date

Its funny that yesterday I was advocating someone to stay put and be patient regarding their case and I got a big blip in my case when I checked my mail yesterday.

I had moved 3 months ago and notified USCIS about the address change. They confirmed it in a letter to me saying that my address has been changed on all my petitions. I also got my EAD at the new address so I was very satisfied that the address has been changed.

Yesterday, I a FP notice was forwarded to me by the USPS. The notice was from USCIS asking me to come for a FP. This would be my second FP as FP expires in 15 months. It said to come by March 10th or else my application will be considered abandoned and denied. :eek:

What do you guys think my options are? I am planning to do a walk in today to get the FP done. At the same time, I will be writing to USCIS explaining the situation and will send them all the correspondence I got from them. I am still not thinking about getting an attorney...no not yet. Oh yeah, I called USCIS CSR and they told me ot write to the ASC instead of DO. It does not make sense to me so I'll write to both. I also have an infopass appointment for April 4th.

I will let you guys know later today how things went at ASC. Anything else you guys think I should do?

Sorry to hear about your situation. I think you are doing everything that at least I can think of. Keep a track of all the mails that you send to uscis regarding this. All the best and keep us posted.

I know that they delete the fingerprints from their database and that is why they require folks to redo it...but to say that fingerprint "expire" in 15 months is like saying you DNA can change with time. Anyways, it is what it is. Best of luck!
 
I am sorry to hear about another INS mistake !!!!! I know you're waiting really a long time already, and now that your file "is moving" a bit, they mess it up !! I really hope that you succeed today with the walk-in ;) !!!

I have a similar situation as yours. My lawyer received the fingerprint request in September 12 2005 and he never informed me about that. I found out about the request and warning yesterday ( my case migth be considered abounded if i dont respond within 87 days) I called 800# and explained everything to them then they gave me an appointment for today. I got my fingerprint done, hopefulluy it will arrive before they close my case. The only problem was at the ASC place they gave me a hard time since they didn't see the appointment on my paper. You will be fine. Good luck!!

I just got back from my FP appointment. It was for TENPRINTS. All went fine. Next, I will write to USCIS and also see if I can get an earlier infopass appointment.

I would like to write to USCIS to explain why I didn't respond my fingerprints request in time, but I don't know where to write, should I write to my district office or Lee's Summit? what do you think?
 
If I was in your situation, I will send a copy of that letter to both places. That way you're safe all around.

I second payala. Also, make sure that you have delivery confirmation for your mails so you can prove in the future (hopefully it won't be needed) that you did respond in timely manner.
 
My LUD has changed to today's date. I believe it's because of the FP I did this morning. However, the status still reads "On December ..... we received your application....."

I hope someone has not updated my file with a denial and its only because of the FP I took this morning. Does anyone know the timeframe before the LUD is updated after FP is taken?

Not to worry...the same had happened to me. that is, LUD on same day as FP.

IT is funny and sad for my DO that they don't update anything on Case Satus online. Yesterday I entered receipt # of my Citizenship apllication just to see. It gave me same message that it was giving me initially when I filed that They have received the application on bla... bla...bla.... I become a US Citizen a year ago. So for me the online status is useless.

Yes, I am talking about LUD for my I-485. Don't worry...you are not alone. My LUD for EAD has not changed and I have my EAD in my hands for the last monht and a half :) I think my LUD changed because of the FP I took which automatically informs USCIS that there is an update on my case.
