My I-140 application was denied last June, and all the underlying applications were denied as well (EAD, I-485). I appealed the I-140 denial, but EAD and I-485 denials are final and cannot be appealed. I understand that very well.

The I-140 appeal is waiting at the AAO for the appellate decision which should come some time in 2005. I understand that very well too.

What I do not understand is that today I got a notice from USCIS whith a scheduled fingerprint appointment. This notice is tied to my I-485 application that was denied a couple months ago (without the right to appeal).

I am confused as I have not any idea what that means (although I will go for FP, since I have paid for it).

I think U go for FP -- this might reopen Ur case -- who knows it might get approved this time.

May I know why Ur I-140 was denied and why U are not allowed to apeal even.

Good luck.

I am allowed to apeal I-140. I can not apeal the I-485 decision. I believe that if my I-140 gets approved from AAO, then I can file a motion to reopen the I-485.
At least that's what I think.
