FP Expired: should I contact Senator?

My FP1 is now 18 months old and thus expired. Can I contact a senator's office for this? Do they help with this (issuance of FP2 notice)? My RFE response has been received by VCS 2 1/2 months ago.

My FP1 was in December 2002 and the results were received on 20 Dec 2002.
Mine is Substituted LC and Concurrent 485/140 case.
I got I-140 approval on 5 May 04.
I have not received FP2 notice.
As per my knowledge FP expires after 15 months. Is this correct?
Another question is what can senator do?

I am in the same boat as you, FP1 is 19 months old. No RFE No FP2 notice. I called USCIS a couple of times, I have been told that when they are ready to adjudicate is when they'll send FP2 notice, they are not sending FP notices upon expiry since they are not sure when they'll be able to pick that file.. and of course I was also informed to wait patiently since they are working on FEB 02 cases.

There are several other people within this forum with expired FPs and no notices, guess we just have to wait.. One might get lucky one of these days.. My RD is Sept 4, 02. ND Sept 17, 02. FP results recd by USCIS Oct 18,02. I-140 was approved in Sept or OCt 02. what are your details.

I also got the same answer from them. Looks like it is their standard answer. My FP expired about 2 months back.
 
Guys, thanks for the information on your cases. However, I believe my case is a bit different as I have already received and replied to an RFE. I guess!

Looks like we are in the same boat, do you know anybody else in the forum having same story - RFE rcvd, replied and waiting for FP2?

Also, could you please share your I-485 & RFE date/details?

You should not call the cavalry just yet. I received a 2nd FP notice after 19, 20 months of the first one and I am certain there are plenty of cases like this... Give it some time.

I can understand the frustration. I have some of my best buddies who filed about a couple of months after me and have their FP2 scheduled for today, while i have not seen any movement on my case since my 1st FP.

While i am happy for my friends, i still feel left out :) (i know a lot of 2001 filers feel worse than i do)

You can contact Senator or Congressman or both and demand explanations about your FP and other aspects of the delay for your GC. Be frank and demanding. Expose the CIS hypocrisy about the FP expiry and the issuance of a second FP, which like the adjudication process itself is unfair, random and stupid.

I just contacted senators office (i had done that a couple of months ago and was told that my case was waiting "inline") and expained the randomness of processing and basically told them the they were being given BS by the USCIS on the theory of FIFO processing. ( i offered proof of my friends EAC#'s but she told me that they belived me !)

The office was very courteous and told me that they would call USCIS and ask for explanations and also pressure them for movement on my case. Lets see the response.

Also i specifically asked if making inquires through the senators office is impacting my case and was told "IT SHOULD NOT, on the contrary there should be positive results as we deal directly with a liason at USCIS"

will keep you guys in the loop.

I have been waiting for FP2 7 months after RFE submitted. Contacted senator office couple of times and called BCIS obvious no use. Finally I was told be patient.

Cinta, I would assume that you would get your next FP notice in the next 1-2 months, if not sooner. Just an educated guess... You are known for feeding this forum with excellent reading material and objectivity, why all of the sudden start panicking? Good luck.
 
Not received 2FP notice after 18 months.

Hi guys, I am also on the same boat. Not received 2nd FP notice yet.
485 ND was 10/25/02 and 1FP done on 12/17/02.

Couple of weeks ago I created the online account at bcis.gov and saw that LastUpdateDate is 5/17/04. Does this mean they did something with the file or it is the dt that I created the login with them? Any idea!!

Details of my case

I-485 receipt Date: Sept-11, 2002
1st Finger Printing received by VSC: Nov 10 2002
RFE Issued by VSC: Sometime in Feb 2004
RFE demands received by VCS: March 31, 2004
Awaiting 2nd FP notice and approval

Initial process start date: June 1998 (state labor certification). Got delayed at every stage but was hoping to get lucky at this I485 stage.


BTW, Wife (dependent): 2nd FP done and results received by VCS on May 4th, 2004.
