Ok we're working on the AOS now...
Do I have to have income if im his wife and my mom is co-sponsor for affidavit ? Or can I write down $0 income as long as i still fill out the affidavit and my mom co sponsors? Could I include 40 dollars a week for cleaning house?

How much income is needed for a family of 5? (living with my parents and my lil sister)
 
Well that's very good progress!

No, you need no income if you have a qualifying joint sponsor filing I-864 or if you can qualify via houshold income/assets of certain relatives filing I-864A or if you can even qualify via assets alone. You can include any income that you can provide proof for. Can you present pay stubs or an employer letter for cleaning house, then yes.

That said, be sure to understand you need to file I-864 as your husband's sponsor, as his petitioner, even if you contribute no income.
 
OK let's see ... I'm assuming might decide to file I-864 and your mom I-864A "Contract Between Sponsor and Household Member." Then you're a sponsor and you include your mom's income as household member (although both of you will be jointly and severally liable).

If I counted correctly, the household size in this case is 3 (you, your spouse, and your mom whose income is included). $21,462 annual required income.

If your mom files as a joint sponsor instead, I believe her household size would be 4 (her, her husband, your sister, and your spouse). $25,812 annual required income.

But someone correct me if I did this wrong please.
 
So $43,000 enough.....

Ok now I am going to have to get more things to prove a bona fide marriage... seeing were young, college students, and living with my parents, there's not much.............
We have so far:
-my married name on Social Security Card
-my married name on my driver's license
-a joint bank account ( not much money though)
-a school information sheet that shows me as an emergency contact
-we're going to get a letter from my parents (sworn to a notary) saying we live with them and they are supporting us.
-we're also going to get some family friends and family to do the same in saying our marriage is real and that they know about the marriage. (maybe 2,3 ppl)

.... What else would we need to get???? Would this be enough at least to send in with the papers when we mail them or do we need more? This is all we can get so far and we can't get a tax return joint cause neither one of us work (except for my 40 dollars for cleaning)

Aus.... what did you send in when you mailed your packet?

Let's see ... we sent joint leases for a couple of years; statements of one joint account; one joint certificate of deposit; one credit card in both names; one joint savings bond; a copy of our wedding program and a couple of pictures from the wedding and honeymoon. We had joint tax returns too.

You'll need to present some additional evidence for the interview a couple of months later, so you better start working on that too. We had something like three joint bank accounts, a handful of CDs with various maturities, three credit cards in both names, a photo album of general pictures of us (travel, holidays, ...) and a wedding album, life insurance with my wife as beneficiary, car insurance in both names, a couple of savings bonds of different types, a renewed lease for 2007 ... I'm sure I'm forgetting some stuff.

Joint bank accounts and savings bonds are pretty easy to get. While you're at it, pick up a couple account opening bonuses here and there. Savings bonds you can buy for as little as $25-$50.

Ok.... So if we get everything together and say we file Jan 21st... (Seeing we married on Dec 10th).. we send in ALL this:
-joint bank account summary
-letters from our bank with both names same address
-letter from parents notarized saying that we live with them and they support us.
-my social security and driver license with my married name
-copies of yearbook pages from high school with us together (like 6)
-copies of letters,cards,movie tickets from each other
-receipts from gifts (ring,watch)
-affidavit sworn to someone who knows of our marriage
-school information listing me as the emergency contact
-pictures from christmas, thanksgiving, valentine's day, birthdays, high school,new years, and high school pictures from our senior year with him in his football uniform and I in my majorette outfit.

(IF more is needed or if some of this they won't care about, please advise me in the right direction)

Sending that WITH the packet... Would that be good enough?
This is a FOR REAL love and marriage, more than the usual they see I think!
I just want everything to go smoothly, Thanks for your help ;)
 
Sounds good to me! Some of those things (like most of the pictures) you may be able to hold off until your interview, but it never hurts to send more than asked for. Whatever you send, make sure you don't send your original evidence (unless asked for in the instructions). If the application gets lost (USCIS sometimes loses items) then you'd be missing your evidence. Send copies only. The pictures we sent with the application were printed digital pictures. Send everything in the same packet.

Ok and on some of the forms like I-130,I-765,I-485 ask for the same stuff like G-325A, and two identical passport photos,, do I send items for each form or since I'm filing them together do I just send the G-325A and two photos once???????
How would I assemble that ?
And also it says submit a copy of visa and passport if issued within the last year...... his is expired and old (2001) do I still copy and send them for I-485???
 
OK, it may help for you to read this step by step guide it has a lot of information. It also suggests a way to package your pictures in zip lock baggies etc.

You'll need 4 identical copies of each G-325A (the PDF reader software should automatically fill them all out at the same time) and treat the I-130 and I-485 packet separately (they're sent in the same envelope, but put a big paper clip on the I-130 packet and I-485 packet to separate them. Accordingly the I-130 and I-485 need separate sets of G-325A's. You'll also need separate sets of pictures for the I-130, I-485, I-765 and so on. In my case I think I needed 5 pictures of myself and two of my wife if I remember correctly (didn't apply for I-131). Most places charge you per 2 pictures but CVS can print you 6 on one sheet.

I suppose if the visa was issued more than a year ago, you don't need to include it. But it probably doesn't hurt to send a copy of it either. I sent a copy of my visa which was issued 1 1/2 years earlier. The way I look at it, it's additional information for them to verify the information you include in your forms. You'll be asked in the forms for his previous expired status anyway I believe.

Just to clarify, did the passport expire too?

So do the immigration officers come to your residence? How often does that happen?

And where it says to submit an affidavit sworn to or affirmed by third parties having knowledge of the marriage, what does that mean? Is that like going to a notary public and making a letter that says they know of the marriage and signing it in front of them and them notarizing it?
