Hi

My wife is US citizen, and we r filing i-485 and i-130. She has 60,000$ per year job, while i earn much more than that. We have joint account and some assets.

For a household of 2, the 2006 poverty line is 16,500 $ per year (125%, actually, for california, and 48 states). I think she qualifies that for a household of 2. Do i have to file i-864A? Would it serve any purpose?

Also, in I-864, sections# 26 and 28 ask for assets for my wife and me (immigrant). If everything is mutual, how should they be listed? same assets in both sections? or just hers?

Thanks

Your wife the USC makes more than enough to qualify so why would you the beneficiary need or want to submit and I864 ? you answered your own question there,IT WILL NOT SERVE ANY PURPOSE FOR YOU TO COMPLETE I -864A Unless you just like to fill out Govt. forms.
The questions on the I864 EZ are in reference to your wifes assetts if she will be using those to determine sponsorship ability,

if she makes 60K a year she does not need to show additional assetts to prove ability to support. Only list HEr assetts as she is the one filing the form as the sponsor,

Thanks Addie, thats what i thought...but the form i-864 is confsuing :)

I see ur timeline. ur timeline looks like mine. I also got married in 6/2004.

Did u also file ur i-485 with sealed medical envelop? or u submitted it later?

Thanks

You're supposed to file all requested forms in one package.
If you submit the medical form I-693 later chances are that you'll receive an RFE asking for the I-693. That puts you in a delay.

question about sponsor's requirement!!!!!!!!!!!!!!!!!!!!

If the person who is a prospective sponsor of an allian carries some debts with IRS BUT is in a process of paying it off...The debts accure about 2-3 years ago and his (sponsor) income was always much more that 125% poverty line requirments. So, my question is if that perosn can be a sponsor.

His taxes are fine NOW. His income is over $40.000 (for household of 2).

Any comments will be very helpful.
Thanx.

There is a misconeption out there that the USCIS cares about taxes because they ask for IRS docs. The only reason IRS docs are asked for is that the IRS is a reliable source from which the USCIS gathers income data. Whether you owe back taxes had tax issues before or whatever is irrelevant.

Yeah, I think eddie d is right. During my interview, all the officer did was look at the first page of our 2005 tax return and he was like: oh ok your income is above. He only looked at the gross income, we do have a lot of deductions like mortgage that are significant and that didn't seem to matter.
