Form I-864 (affidavit of support)

Hi,

I currently hold an H1-B visa and am working in the US. My fiancee is a US citizen, and we are getting married in April. She was laid off from work last November and she is going back to school next fall. Needless to say, she, by herself does not earn enough to qualify for "125% over the poverty limit" criteria when sponsoring me for the green card.

a) Can she use my income in I864 (I864a says that the household member cannot be a cosponsor)?
b) If not, can my sister/brother-in-law, who are green card holders be a co-sponsor?

a) Yes she can use your income.

I am in the exact same poistion as you are. My interview is on the Feb 12th. So far there have been no problems.

So, does she fill out I864 and include my income, and then I have to provide my tax returns for the last three years, along with her returns, as proof? Or do I have to fill out an additional I864 or I864A? (This is all very confusing).

a) She can use your income if you have been living together for at least six months.

b) Co-sponsor is also an option.
