Form I-129 for TN

Hi there guys,

I need some help filling out this forum so please any of you who have experience filling out this form....pls help me out.

The situation is that I am as a canadian citizen and am working in US a consultant through a consulting agency. The agency is filling the form for me. They have filled out the I-129 form and allowed me to recheck and make sure that everything is accurate. This is my first time requesting TN extension so i have no clue what the custom officers are looking for. Hence, i would like to get opinion of someone who has been through this process.

1. My employer (agency) has not filled out anthing for PART 1. because it's an organization

2. For PART 2 (Basis of classification) they have filled out:
CONTINUATION OF PREVIOUSLY APPROVED EMPLOYMENT WITHOUT CHANGE WITH THE SAME EMPLOYER

3. For PART 3. They have left it blank, but i think I should fill out my previous I-94 form no. right. Is this correct or no? Should i just leave it blank

4. For PART 4 (Prior Petition)...My agency have left that blank as well. What should i fill out here. (again my I-94 number or what?)

5. For PART 5. (Requested action). My agency has filled out
EXTEND THE STATUS OF A NON-IMMIGRANT CLASSIFICATION BASED ON A FREE TRADE AGREEMENT

6. For PART 6. (Total number of workers in a petiton): it's just me so i guess only 1.

FOR PART 4. PROCESSING INFORMATION
Question 7. asks for HAVE YOU EVER AN IMMIGRANT PETITION FOR ANY PERSON IN THIS PETITION: This should be NO right, since they have never applied for any greencard petition for me. I know it's a stupid question, but i just like to make sure. Cuz i don't want to get my TN extension denied. I hope you guys understand.

Question 9. HAVE YOU EVER PREVIOUSLY FILED PETITION FOR THIS PERSON: I am actually confused on this question....Should this be YES or NO. I mean last time i got my TN from Border (when i crossed the border) so technically, they didn't actually filed a petition for me. But then, again they did provide me employment letter and other paperwork for the custom officer.

What should be the answer to that question. Should it be YES or NO.

Again guys, i know some of the questions are really obvious, but i just like to make sure because i don't want my TN extension to get denied. I will really appreciate any/all replies.

Question 3 and 4: Your current I-94 number
Question 7: you are correct. NO
Question 9: NO. A previous non-immigrant petiton would be a I-129. SInce your current TN was acquired at a POE, an I-129 was never filed before.

I appreciate your prompt reply.

However, i have some new questions for you.

Under Part4 for processing information, I-129 form states that: IF THE PERSON IN PART 3 IS OUTSIDE US OR A REQUESTED EXTENSION OF STAY OR CHANGE OF STATUS CANNOT BE GRANTED.......BLAH BLAH BLAH.

Now, i am already in US....so do i have to fill out PERSON"S FOREIGN ADDRESS. or do i just skip to question no. 2.

My second question is about NAICS code? I tried looking up that code, but unfortunately, my job description doesn't fall under any category. My employment letter state computer system analyst. And the categories under professional employment that i searched do not have that job title. What should i fill in for this category. Last time i got my TN under "computer system analyst" so i know that this category exist, but i can't seem to find the number.

Can you or anyone please help me out with this NAICS code.

2. use one of the following
Custom Computer Programming Services
Computer Systems Design Services
Computer Facilities Management Services


For the NAICS code you have to find the classification that BEST suits your profession, not the exact name.

Sorry Gunt one more question...

So what exactly do i send to USCIS.

1. Employment letter
2. Money order
3. I-129 form (petition for non-immigrant worker)
4. I-129 form for TN visa
5. Copy of I-94
6. BSc degree copy

Do i have to send in I-94 form copy and BSc degree copy or NO?
