Hi,

My LC is still pending approval, I got my 7th year extension approved recently and plan to visit India soon. During my stay there, I will have to get my visa to re-enter US. So, I was going through the forms and got stuck here, not quite sure whats the right answer to this question.

Form DS-156, Question 36 :
Has Anyone Ever Filed an Immigrant Visa petition on your behalf?
Yes --- No --

One of my friend says the answer is 'No' in my case (since is LC pending) . He says, Its 'Yes', only if you have filed for your I-140 already.

Is this true? . Anyone faced the same situation recently?.

If you get a definitive answer from a good source could you please let us know.

I agree with your friend. To me, an immigrant visa is either I-140 or I-130. But, an immigration lawyer once said that it was "misleading" to think this way.

Please post anything new you learn.
 
Your friend is right..

My I40 was pending while I visited india in Feb. I answered 'YES' to the question as not to lie. I got the H1 visa stamped for 7th year without any problems.

what kind of documental proof we need to apply for 7th year ext. of H1 B?

Though my LC is pending in NJ morethan a year, i dont have any reciept from them which states they recieved the applicatoin of labor. So how to prove the seniority of 365 days in LC?

Please let me know.
