Form 1-485 filling need help please ! ( former TVU student )

We are applying for AOS through marriage. My husband is USC. When i was filling the form i-485, there are lots of things i am not sure about. Need help to fill out the form. I have following questions:

My situation:
I came in 2007 as a student on F-1 visa. I finished my school and got OPT after graduation. My opt ended on Jan 2011. I fell out of status from Jan2011-Mar 2011 due to school was closed. (Former TVU). Later i went to a different school, and applied reinstatement with USCIS. But my application is still pending until now. Meantime, the USCIS sent me a letter requesting more documents showing i attended school since March 2011. I registered full time classes with my school in since March. And still attending school until now. We got married last month. And we are doing my application for AOS.

I am so concern will fell of status due to TVU affect my AOS to green card from my husband? Do i need to submit more proof to show i came U.S. for school and the marriage is based on good faith?


1: Do i still put on the form as STUDENT status? Do i have to attach a paper explaining my situation including i applied for reinstatement of F1 status?

2: When to mark N/A OR None? Like i do not have a middle name, apt #, no previous marriage, no children, etc.? Do i have to fill out with N/A or None or just leave them blank?

3: The form asks about current status expiration date. On my I-94, NO expiration date is indicated. What expiration date should i put?

4: My husband is naturalized citizen, and do we need to fill in his green card # #) as well?

5: Part 1, under the address part, what is c/o (in care of)?

6: Do we still need to send in proof of bona marriage with the form i-130? Or bring it later for the interview?

7: On the form Part 2: Application type, which one is applicable to me? We are filing concurrent.

Are you sure you did not get a deportation order or Notice to Appear before an immigration judge? This is because quite a few of the TVU people got NTA. Make sure of that because in that case you will have to appear before an immigration judge before you can adjust status.

3. D/S or also known as Duration of Stay

6. Yes send as much evidence as you can.

If you don't have a middle name, leave the middle name blank. If you write N/A for your middle name you risk having your middle name show up as something like Nia or Na on the card. And leave the apartment number blank.

And i still have some questions here:
1: Do i have to send in all my previous I-20s along with the i-485 and explanation of my situation?

2: Is it required to send in proof showing this is a marriage in good faith?

3: My birth certificate doesn't have my name on it. Because at that time my parents had not name me yet. And it is also in foreign language. Do i have to get some other documents to show my name? or just get it translated and send in a photocopy?

1. Yes, send all I-20s that you have had. It might be of help to include a letter detailing your situation.

2. It is not compulsory but helpful to send them with the application. Sending them might make the IO relax with you because he/she would have gone through them before your interview. Either way, you have to have all originals and at least a photocopy of each on the interview day.

3. Submit all old documents showing dates very close to when you were born. e.g elementary school report cards, Vaccination records. Also take affidavits from both parents, grandparents, uncles and aunties that witness your birth. Also request for a new birth certificate from your country. All original non-English documents must be translated to English.

All the forms i-130, 485,864,765 and 325 a should be originals, and i make copies to bring to interview? Thank you.:o

I meant the supporting documents like your utility bills, bank statements*, birth certificate, passport, visa, I-20 etc. sent with the application should be copies. But the I-485/I-130/etc. forms should be the originals that you printed and filled out.

Anything you send will take a long time to be returned or possibly will never be returned. So whatever you send, think about it from that perspective; only send what you're willing to part with.


*if you have bills or bank statements that are downloaded and printed, instead of delivered to you physically in the mail, you can send the original printouts since you can always make another printout.
