I am also among those of you who have been affected by the recent retrogression in priority dates since my PD is Sep 2002 although my CP case was sent to the Chennai consulate in early November and I was expecting a January interview.
However, my wife was not born in India although she is a naturalized Indian citizen and my attorney mentioned that under a provision, although I am the primary beneficiary of the EB3 application ,We can use her country of birth for foreign state chargeability and we both will be counted against that country's numbers for FY2005 and not be affected by the retrogression.
Is she correct? Please help.
