Folks,
is there any kind of dependent visa for LPRs? is yes then can some one explain me what it is and how it works .

I have been hearing mix stories, some one says that there is something which you get in 4 months other says there is something which you get in 4 yrs

what LPRs do in this case?

any thoughts?

like h4 is dependent visa for h1, do we have anything for GC? if yes then how does it work and how long it takes

Chubber,

There is no dependent visa for a LPR. IN this regard H and L visas are much better as they allow you ro bring your dependents. But once you are PR only option to bring your wife is with some kind of non-imigrant visa for her. Like B2 or H1. Be advised the only thing you can do is file for her GC and this does take 4 years ot so to come.
 
so bottom line is that if you are LPR then u can't get married to some one from india, ok let me ask this.


what if I get married to some one from india and beofr she could come to US, i get my 485 approved (I did my FP last week and i can not go to india till feb or so and my attorny says that case should be approved in 6 weeks or so), in that case she can't come in the country, getting B2 visa, F visa may be difficult as they as soon as they will find out that husband is LPR, they will chop the application right there.

some one told me that if you i-485 is approved but is not stamped u can still file for you spouse, is it at all TRUEEEEEEEEE?

If you get married before your I485 approval, there is no problem for her to get green card. Keep in mind that, the marriage date has to be before your approval date (not passport stamping date). If she can come to USA with H4 visa you can file her I485 immediately. Or if she cannot come to USA and your I485 get approved meanwhile, still you can go for consular processing for her green card. In that case, she will enter to USA with immigtant visa (green card).

Yes, she can apply her I485 (provided she is here) after your approval, but there is no significance of passport stamping in this issue. All that matters is approval date. The day you are approved, your wife's H4 becomes invalid. However, even after your approval you can file her I485. She will be out of status from the day of your approval to her I485 receipt date. But that is covered by 245(k) provided she applies her I485 within 6 month after your approval (245 covers upto 180 days of out of status issues).
