For those who have applied 485 in past and got retrogressed

hi guys,

I have a quick question. Suppose an I 485 application is recieved on July 1st and then date retrogresses in a few months.

Would INS continue the processing steps like FBI check and so forth, and not issue final green card until the PD becomes current.

Or they would just stop working on the application as soon as the PD becomes non-current. The FBI and finger printing will resume when the dates would become current.

Once filed, thats it. If your PD is retrogressed, then you may not get approval but USCIS will (may) work on your case like sending RFE, FP notice/Biometric notice.

And you will get unlimited EAD/AP until your I485 is approved

This one is correct. Approval-wise, your case sleeps on the shelve once it is retrogressed. But they (supposedly) keep working on the case to "preadjudicate" it. Then sit on it until NC is cleared AND PD becomes current.
 
Mine is a little sticky. The application got to USCIS only on June 27, 2007 (my PD is July 2001). This means that my application was probably not in the decision statistics USCIS might have used to determine that they ran out of numbers for 2007, since they barely had it for 2-3 days. I don't believe they are *that* efficient you know :)

So, fair bit of chance that my application will probably sit there for 3 months, and wait for 2008 numbers to open up. I hope they at least start the review and FP and such, so it makes me feel better :)

It's been 7 years, what's a few more ha?
 
PD is Priority Date. You LC applied date becomes your PD (for the LC you use for your 140 application).

USCIS also received mY 485 petition on 07/27/2007. Do you think that we receive receipt nos? Soem sites posted that our applications will be rejected and some other sites posted that the effective date is 2nd Jul. Not sure what will happen.
