CIS eases rule on tax returns for applicants
Immigration

"The United States Citizenship and Immigration Services (CIS) now requires applicants for permanent residence to file only one year's tax returns with a Form I-864 Affidavit of Support. Previously, the CIS required three years of tax turns. You now need submit only the tax return for the year immediately prior to the sponsor's signing of the Form I-864. U.S. immigration law requires these affidavits in all family-based immigration cases.
Also, the CIS has clarified that where the law requires the affidavit of support, you must submit it simultaneously with the application for adjustment of status. Adjustment of status cases are those where the applicant is applying to interview for permanent residence in the U.S.
Under prior rules, sometimes you could file the affidavit at the time of the adjustment of status interview.
Filing your own copy of your tax return may not be sufficient. It's best if you file a document from the IRS confirming that you filed a return. You can get that document either by filing IRS form 4506T or by calling 1 (800) 829-8374.
Only one year's tax return also is required for applicants applying for permanent residence abroad."

Thanks so much. This information is really helpful. I just got my GC and I wish that rule was in effect. My wife and I had to look though all our stuff for 3 years income tax returns

Wants residence for spouse
who overstayed visa

Q. What forms must I file to get permanent residence for my wife? What are the filing fees? My wife came here as a visitor, then overstayed. I am a U.S. citizen.
Mike Williams, Manhattan

A. To get your wife permanent residence, you and she must file the following United States Citizenship and Immigration Service (CIS) forms: I-130, Petition for Alien Relative (filing fee: $190), I-485, Application to Register Permanent Residence or Adjust Status (filing fee: $325) and G-325A, Biographic Information (one G-325A form completed by each of you - no fee for this form).
Under recently implemented rules, you also must submit CIS from I-864, Affidavit of support (no filing fee). And your wife must submit a medical examination from a CIS-approved "civil surgeon." If your wife wants to work, she should include CIS form I-765, Application for Employment Authorization (filing fee: $180).
You can get the forms and filing instructions by calling (800) 870-3676, or going online to: http://uscis.gov/graphics/formsfee/forms/index.htm.
At the Web site, you can get the names and addresses of civil surgeons in your area. The instructions for the forms explain what documents you must submit to prove your case.
Send all the forms and documents in one envelope. If you are using the U.S. Postal Service, send the envelope to U.S. Citizenship and Immigration Services, P.O. Box 805887, Chicago, IL 60680-4120. If you are using a private carrier such as FedEx or DHL, send to U.S. Citizenship and Immigration Services, Attn: FBASI, 427 S. LaSalle, 3rd Floor, Chicago, IL 60605-1098.

Though this is not mentioned on the USCIS website, i asked the immigration officer when i went for my interview. He confirmed this and told me he only needs the 2005 federal return copy or the IRS transcripts for his records. Since i had not yet filed taxes for 2005, he took 1040 from 2004 and also my W2 from 2004.

Thank you, Ari. :)
It's always good to have a confirmation from someone who has a fresh experience about the issue.
