I have a labor under EB3 with PD 2003 with I140 approved. Now I have filed a new labor under EB2 in PERM in jan 2007. The purpose of filing the new labor, is to retain the old PD , and have the visa number available under EB2 earlier than EB3.
1. My attorney, suggested that the old PD can be retained only in filing new I140 stage. But not during the filing of PERM. Please give advice, is this the right way of retaining the old PD?
