Here is my lawyer told me about his conversation with USCIS lady:
The I-485 is still pending. They are currently working on December 2003, your case was filed March 2004, so it will be several weeks until they get to it. The I-485 is no longer tied to the I-140. That is one reason the I-140 was approved as fast as it was. As long as the I-140 is approved in December, the I-485 will be adjudicated in line, so in about two or three months. It will not be held up because of the backlog.

jdr, your case was filed in Feb, let's see if your case can get approved soon.

Did your attorney say that CIS is processing Dec'2003 cases (or Dec'2002) cases ? Anyway, the point of retrogression was to process the oldest PD cases first. That means it doesn't matter when you filed your I-485, you should be approved based on your PD. You should be approved soon based on your PD. Almost all of the cases that are approved in 2005 I have seen are based on PD. Is your attorney correct ? Did I miss something ? Just curious.

Your lawyer said they r no longer processing I140 and I-484 together? Is this true for cases that r NOT in countries like India, china?

My 140/485 was concurrently submitted in Dec. 2003. My 140 was approved on Dec. 16., but there is no news on 485 yet....
 
I called ins about concurrent processing, she said they are still processing concurrent applications, lets c what happens.
