All,
I talked to senator\'s office. The lady who takes care of immigration issues told me that she has called TSC twice one of 22 and other today they dont even respond to her call?
I donno what the heck is with TSC

Was your case assigned to an officer on 1/13/01 or 1/13/02? If it was last year, I\'m sure there is a problem with it. You should inform this to your congressman/senator/attorney/IIO about your concern and make sure it\'s in progress. However, if it\'s this year, probably it\'s better to wait a few more days. And hopefully the approval will come to you soon.

I contacted my senator couple weeks ago, and today I received a letter from him that I need to sign the Privacy Act of 1974 to authorize the disclosure of my information to him. Since the IIO I spoke with today said my case was assigned last week, I\'m going to wait 2 more weeks and decide if I need senator\'s help.
 
Yes my file is with officer 154 since Jan 13-01

I am more leaning towards that theory that there is some problem. Either they have misplaced the file or something like that. Because
Senator\'s Office sent them a letter in Nov and they did not respond. Also they have called twice but no one responds back to their calls.
What course of action you suggest for this ?

Do you think it\'s possible that your file might have been lost? You said you spoke to an IIO and she refused to give you any information? I think you have to state the fact that your case has been assigned for over a year and you want to make sure your case is still in progress. Ask the IIO to check the status, and ask her to put in a note to her supervisor that your case has been assigned over a year ago and you\'re afraid there is a problem with it. In the meantime, contact your congressman as well because he might get a different answer from TSC.

That\'s just my suggestion. It\'s horrible to think a case could take over a year for approval after it\'s been assigned.

It is highly unlikely that your case is lost, especially as I have
discussed your case with the Texas Service Center on a number of occasions.

We would not have received the FP Notices and there would have been no
action at all on your case if they had lost the file. I am confident
that we will hear something in the very near future.

Please remember that the Texas Service Center is presently the slowest
Center for processing I485 applications and the least efficient in
providing customer service.

When did you do your 2nd FP? Could that be when the officer reviewed your case and realized your 1FP expired. Therefore, he/she sent a FP request to the FP department to issue a 2FP notice to you, and your case was on hold at that time. When you finished your 2FP, your case should resume but didn\'t. That\'s just my guess. I think the most efficient way to get this resolved other than waiting is to talk to an IIO and hopefully you\'ll get to speak with a helpful person who can do something for you.

I had talked to a helpful IIO on Jan4, and she emailed the person who had my case. Lets see if it helps. I am not too optimistic tho

Shahidimam, don\'t worry, I think this is what could have happened

Your case might have gone to an Officer and returned back because the PD was not current for EB3 filers till March 2001. I don\'t think officers keeps cases with them when the PD is not current for the case. When the PD did become current in March 2001 (or Feb 2001 ?), your FP probably expired and your case may not have been assigned to an officer. Now since you have done your 2nd FP, your FPs will be reviewed and your case will first go to a supervisor. The supervisor will then assign your case to an officer. If you have done your 2nd FP, then your case is very much intact. It may have already been assigned to a new officer or waiting to be assigned soon. In any case I do not think your case could still be with that previous officer since 01/13/01. You may talk to an IIO and see if it is already assigned, if not ask him/her to put a request to his/her supervisor.

Don\'t worry, most approvals come within 2-3 months from 2nd FP.
