I am looking for hope.
Short version:
1) Married before I got my GC
2) My wife converted from H4 to J1 in May 2001
3) I got my GC approved in 2004 (EB3 RIR, priority date 23 July 2001)
4) Applied J1 Waiver for my wife in Family Hardship category in Sep 2006
5) No adjudication as of June 2007 and my wife left to India with 2 of our USC kids
6) Waiver petition denied in Sep 2007
7) Appealed and got the waiver in May 2008
8) Applied for Follow to join (I-824) in March 2008 (Yes, before the waiver approval to get seniority in line)
9) I-824 processed in Sep 2008
10) NVC asked for PCC and other documents for CP in Apr 2009
11) Filed the requested documents in May 2009
12) NVC processed the documents in June 2009
13) NVC says no action as the immigrant visa number for India is currently unavailable.
Honestly I was under the impression that NVC would process the documents, only after assigning visa number. This was a shock when we were planning for my wife and kids to be here by the end of July after the interview at the Consulate.
Please let me know if we have any hope at all? If not in July at least after October 1st 2009 when the new fiscal year starts? I am tired of traveling to India so often and it is risky, given my medical condition. I was frustrated before but not any more, I am just DEPRESSED now.
Specifically I want to know how the visa numbers are used.
Meaning, who gets priority
1) person A with priority date as Oct 2001 and filed an immigrant visa petition for the spouse in Jan 2009
2) person B with priority date as Aug 2001 and filed an immigrant visa petition for the spouse in Apr 2009
