Folks who are stuck in name check and thinking about WOM

Guys!! I just got my I-485 approved after 38 months of applying it and filing WOM as it was stuck in name check for over 3 years. Just so you know that my lawyer told me that they received a memo on December 21, 2006 that the USCIS will no longer accept an expedite request. He told me that he does not know what the outcome of recently filed WOM will be as the defendant to WOM is not only USCIS but also FBI, homeland security, U.S. Attorney General etc. Whoever is waiting for years for their name check to get clear or planning to file WOM I guess you will have to hurry because if USCIS decides they won't accept expedite request, I don't know how would the WOM law suit be dealt with.

This is just the information that my lawyer told me and please don't take my word for it. This is the information I got from him and would like to share with the friends who is going thru the ordeal that I went thru. I am not a lawyer so please consult your lawyer.

first of all congrats. Expedite request is I think different from WOM. I sent many expedite requests that were probly discarded in trash. WOM is a legal action that they have to respond to. Yours must have worked.

I have been informed by USCIS that I am under "Extended Review" with regards to FBI Name Check.
Can anyone tell me whether traffic violations constitute part of the FBI Name Check?
Additionally what is a WOM?
My status has been so for the past 6 months.

I don't have any letters as I hired my attorney to do it. But there are other places in the forums where you can get the info.

When you file WOM, USCIS sends the expedite request to FBI for expediting name check. My lawyer is not sure at this time on how would it affect if you file WOM and USCIS won't participate. I was told by my lawyer that U.S. Attorney General who also is one of the defendent may try to do whatever possible to involve USCIS to work on the case. I guess it will take a while till we find out what would happen about WOM cases filed now.

I think it's a good sign. USCIS does not want to spend any more time because of FBI slowness, let FBI defend themselves. This should create more pressure on FBI to be responsible for the namecheck processing, and to fix their system.

I agree...

As we file WoM we should have FBI as one of the defendants. So FBI needs to respond to the request faster and USCIS wont need to send the expedite request in that case.

Do folks who filed WoM add FBI as one of the defendants?

Could anyone of you recommend a good lawyer in Washington, DC who O could use for WOM? I really appreciate in advance.

One good lawyer is NJ is Ed Rubin: 973-735-2730.
But he is expensive. I think he charges about $250 an hour.
He has 30+ yrs experience and has won some WOM cases as well. Also he's pretty straightforward and won't cheat you and will work on your case as fast as he can.
You can expect to spend at least 10-15 hrs worth of pay so about $2500 - $4000 for him.
