FOIA Request with DOL or USCIS

Hello Everyone,

My I-140 was approved recently. I am looking for a better position but my employer is not giving me details of LC and neither the LC approval copy. I however have a copy of my I-140.

I have read in this forum that you can get details using FOIA by filling up form G-639.

I want the complete details of my GC (Labor and I-140 details)like job description, salary etc... so that I can get a EVL from the new employer with the similar job description and responsibilities.

What do you have to write exactly in the Item 4 in form G-639. ??? and do you need to notarise it even if it's requesting information for self ??

Also read that you can file FOIA with DOL for LC details, does anyone have experience on it, please share your inputs..it will be of great help... FED UP of these desi employers ....

This is the exact question I had
with retrogression around , AC21 is going to be the ONLY option.
It would be nice if we someone who has filed FOIA can explain the answer to the question on how to obtain copy OF approved labor and i-140 using FOIA
I beleive these are the most critical things when looking for next job USING ac21

Hi,

I filed FOIA and got copies of I-140 application, Receipt Notice, LC copy. All you have to do is to download 'Form G-639', fill it and send it to the FOIA office at the respective center where your case is filed. I'm trying to locate the link where you can fax it before you send it by post. This will have some speedy response.

By the way, you do not have to get it notarized. Give as much detail as possible (especially for the * ones), sign and send it.

Thanks newkidhere for the link. One more question. I have the I-140 approval copy and the I-485 receipts and they were filed from NSC. I dont have any details about my LC, whether it was filed in Chicago or Nebraska(its either of them, its not a substitute labor, my own labor).

So where is the FOIA request to be sent, IL or Nebraska.

How much time did it take for you for the FOIA request and from which center ?

But how muhc time it took for you to get the docuemtns.
Plus can we request for 140 approval copy and ETA 750A, to know the job responsibilties put on LC.

Also I have heard in this forum that if you request docs thru FOIPA, then our original file from USCIS goes to this centre, and the whole 485 approval process delays or something like.
can you please thow some light on this.

processing time for FOIPA

Can anybody tell me the processing time for FOIPA for approved I-140 documents, I am thinking of applying for now.

and also If I apply for FOIPA - I-140 docs, my company or attorney will know
about this.

After seeing some posts in this forum, i decided not to apply for FOIPA. FOIPA will take almost 1 year, so i dropped filing FOIPA. but i am struck in Name Check. I got this info (stuck in name check) thru senator and customer service rep.

Here is the most recent info pertaining to my case.

FOIA form mailed - 04/29/05
FOIA Receipt Letter from USCIS - 05/10/2005
Documents were mailed by USCIS - 04/19/2006
Documents finally RECEIVED on 04/21/2006.

Approximately it took a whole year to receive the documents.

I'm one of the unlucky ones. Just few days after I applied for FOIA there was a change in process which brought a lot of delay. People who filed few days or couple of weeks before me got the documents in less than a month and for me it took a whole year.

The last time I enquired in early March 2006 there were over 90K requests and USCIS was processing around 7K cases/month.

Thanks for the update, CaliGC. jeez, looks like I have to give up on FOIA. What kind of process change screws up the system? What did they do?

Also, do you know if you can ask for I140 approval copy without 485 being filed? Will they accept it?

I'm not sure about the change in process but I think it is a nice excuse for being lazy for the USCIS.

Yes, you can ask for the copy of I-140, Labor petion approval without filing for I-485.
