First Time Stamping

Hi,

I came to US as a student on F-1 and now I got a job and I am on H-1.

Can any one let me know whether I can go to Canada for stamping.

If yes, can you please let me know how to proceed.

US consulate have discontinued stamping for other nationals. So you have to go back to country of citizenship and have it stamped.
You can have it stamped next time you visit India I presume

You can definitely go for a visa to Canada, specially since you have studied in the US on a F1.

Though this is the WRONG FORUM for this kind of question here are a few tips:
1. http://www.amcits.com/vancouver.asp - Where you can get more info on making an appointment etc.
2. Make sure you have no gap in your legal stay in the US.
3. Make reservations well in advance for everything.
4. Get a Canadian visa.
5. Use "www.google.com" for basic information and this forum for specific ones. People like to help others who try to help themselves.

I don't know whats written on the consulate websites. I have recently heard from quite a few friends that US consulate in Toronto is no more entertaining the H1b stamping for foriegn nationals. They are asking for Canadian PR Card or IMM1000 landing paper to ensure you are a Canadian resident if you request a renewal stamp. Even if you posses a Canadian PR , if your country of citizenship belong to one of "those" 21 countries which appeal officer, they are asking to wait upto 3-4 weeks in Toronto for US FBI clearance.

Please before shooting down websites where the information posted is allegedly by the department of state (whose business is to issue visa's) take a deep breath.

VISA stamping in Toronto

The guy who sits next to me failed to obtain his VISA stamp from Toronto 2 months back. He had a F1 stamp in his passport and was trying to obtain H1. Officer in Toronto asked him to go to home country. I have heard similar experience from another class fellows in Cisco who tried to get VISA from Toronto. He also had F1 stamp. I am talking specifically about US consulate in Toronto, they have intermittent behaviour.

Call consulate directly and confirm with them.

I don't know about other consulates.

Any link about recent experience in Toronto consulate? I am still sticked to the fact that Toronto consulate is highly intermittent after Sep 11 in regards to VISA stamping if you don't have Canadian PR.

The scary part is that even Automatic revalidation will not work if you once apply for VISA and refused in Canada.

I agree to your statement about visa stamping being intermittent. But then I am sure you will agree with me in saying visa stamping is intermittent everywhere. :) There are no guarantees of getting a visa stamped even in your home country.

My point was simple, there is no law that says you can't do third country stamping in a Canada/Mexico. I know 2 people who did that in the past month (vancouveer/Mexico city).

I can understand your concerns over Toronto, I had gone there in '99 and even then it was a tough stamping experience.

But my belief is if you have all your documents in order, present a clean clear cut image, have a F1/education in the US, with no lapses in coverage, H1 visa stamping should be a breeze.

Check the H1 stamping forum links in my previous post. That forum deals with these issues and you will see that most people there will agree to my logic.

Hard luck about your friend, and about the fact that 'contiguous countries' travel rule has been rescinded. :( That was one blow to H1 applicants, and the main carrot behind applying for a visa in Canada/Mexico.

Sorry if I came across too strong in my earlier posts, I don't like to spend too much time in off-topic threads since it eats into my time from other forum threads, so tend to be a little short.
 
In spite of being off topic,

whatever the websites and rules say, the fact is that visa stamping for change from F1 to H1 is not being done in Canda and Mexico. I know of 2 people who had the same issue. :eek:

You are beginning to sound retarted! You sample 2 cases and issue a blanket statement opposing a state department website as well as other immigrationportal.com members who have received their approvals.

Have you even looked at the H1 forum where people are posting their experiences on this issue?
 
Little difficult situation

Hi Group,

Here is my situation and I need some help.

To start with I am an F-1 student who moved on to H1-B while I was on my OPT.

I got my H1-B in Aug 2003 ( thru a consultanting company). But I actually got job in Nov 2003 and I am in the same project till now and this will go next year too.so my employer paid me my salary from Aug2003 till Apr2004 in two big paychecks. And after that he started paying me By-weekly. So I have regular paystubs from Apr 2004 - Aug2004. And from Aug2003-Apr2004 I have 2 paystubs.Now I am planning to go for stamping in Canada.

So here are the questions that are killing me

1)can I go there with the pay stubs that I have ( 2 big ones and remaining By-weekly)

2)The company I work with is a startup( I am the first employee)

3)Its run from their appartment( Heard Consulate is askin for photos of office)


4)Do they also ask for Tax returns.

5)Any other IMP things that I am missing.

Please try posting in this forum

Btw, am not so sure that needing photos of the office is pertinent.
I have friends that work in large companies and most of them have rules that prohibit taking pictures of offices (inside and out) for giving to someone -- so you can conjure up such a rule, if needed ;)

Plus paychecks for the last 4 mo is enough (8 paychecks) -- forget the 2 huge ones - that's asking for trouble.

1. You don't need all your paystubs, just the last 6.
3. Never heard of photographs being proof of employment. Just provide an EVL, should be enough.
4. No harm in taking them. I wasn't asked for them, but you can never tell.
5. As mentioned above, this is the wrong forum. I have posted links on this thread in the past though, they probably carry a list of documents you can refer too.

I went to the forum that u suggested and found that having higher studies in
US( M.S) and workin in the same field as higher studies should be fine.

but mine is a different case.I did my masters in Electrical engg and right now I am workin in Comp sci field.So is it bettr if I go back to my home country or still try MEXICO.

I don't think most immigration officers know the difference between the two. You will be probably better off posting these questions in those forums where they deal with these issues on a daily basis, which gives them a better grip on the answers.
