HI everyone:

My father is a green card holder. And for some health problem, he is away from usa for three years now and never pay for the tax. He is retired but receives money from the company every month for retirement. I am just wondering if he will affect me to get the green card by not staying in usa and not paying the tax? Any advise what should i do next?

Thanks for your time!

If he's been out of the country for 3 years on a green card, and hasn't filed taxes for those three years, his green card is now revoked I believe. You are required to be in the country for at least 1 month a year, and file taxes to maintain your GC status.

Your post confuses me....are you asking whether his PR status is revoked? Probably. Dr Iha explained that well and succinctly. Are you asking how this will affect your GC application? You do not provide enough info. Is your application based on his status or based on e.g. marriage?

perhaps there isn't any hope, but you better get all the health info and show them. did you guys at least made an attempt to get permission to stay for such a long time? any and all correspondence should be up and ready to be shown.
