First Time EAD: Apply withour Lawyer

Hi,

We filed our I-485 (for me and my wife) based on my employment in Dec 2004. We did not apply for EAD or AP as she was pregnant. In Nov 2005, both of us applied for AP using the same lawer who is handling my case since begining. We travelled to India and returned on AP.

Now she wants to work in the US. I am still working on H1 authorization as I am with the same employer who sponsored my H1 and GC. None of us had applied for EAD at any time. I still do not plan to apply for EAD as my H1 is valid till Nov 2007.

My questions are:

1. Can we apply EAD only for my wife?
2. Thew lawyer is asking $ 600 for EAD application per person (sounds too much for a couple page application). Can we apply for her EAD on our own? Please keep in mind none of us has ever applied for EAD before.

I would appreciate if some gurus can guide us.

Applying for AP or EAD is not Rocket Science. This is my Third EAD/AP that I applied by myself and It was approved without any problem. So surely you can apply EAD/AP by userself.
To my best knowledge, You can apply for EAD both for you and your wife. H1 has nothing to do with it. H1 will be valid till whatever time is left until unless you change the job and use that EAD card under AC21. And if you are not using EAD than relax you dont have to worry about H1B.
The documents you need to file EAD are as follows:
1. Filing fee (personal Check, I guess $180 go check on www.uscis.gov for fee)
2. Completed form I-765
3. Mailer Card from previous EAD (if it is first time then ignore this)
4. 2X Recent Photographs (front side, Check the photo requirement on the www.uscis.gov)
5. Color copy of passport information page
6. Copy of approved/pending I-140 petition/receipt
7. Copy of Marriage Certificate (if applying ead for your wife and you are the primary GC applicant)
8. Copy of pending I-485 receipt
9. Copy of H1B (optional but good to include this also)
10. Copy of Old I-94 (front & back)
11. Copy of driver license (optional but good to send it)

Attach an application to USCIS (whatever your servie center is) with your SSN, A# and your signature.

Item 14: Manner of last entry.

Since both me and my wfie returned on advanced parole, what is the answer? My H1 is valid till Nov 2007 and I am still working for the same employer. So I am in H1. What about her? Is she on H4 or is she AOS applicant? I read somewhere that once you used AP to enter, H4 is invalidated. Can you please clarify.

Item 15: Current Immigration status

Again the same problem!

Item 16: Eligibility Category

My case is clear. Employment based Adjustment applicant. What about her? Is she Employment based Adjustment applicant or Family based Adjustment applicant?
