First Interview- 485 Pending-Garden city, NY

My interview (11/10)was really weird!!!
I have a FL drivers license and the officer said that it conflicts with the fact that I live with my husband. I explained that I have had the DL before I got married and before I met my husband. As a visitor I travelled a lot and i did not meet NY requirements. I just didn't change it over-I hate the fact that you really do have to think about "them" with all decisions! He would have a hard time proving that I live in FL anyway- I have been working, living and going to school in NY.

He asked me where and how we met- I gave him a 2-3 sentence answer and he said that's it? I was like yeah, you are asking me how we met right? He said yes, but is there anything else such as how did he get your tele#- I felt really on the spot because I didn't have too much more to say. I added that I met him through my brother so he already had the number and he called me one day, we went out and we've been dating ever since. I got nervous because i was like what the hell does he want me to say. I didn't say anything else- I spoke the truth and just kept it just like that.

He asked my husband where he works- he said in CT. He asked him why CT and if they didn't have anyhting in NY? I live a stone throw away from CT. I was like huh???? that's a weird one. CT is pretty much right there especially from the Bronx. He then said so you have a car right? - yes I do.

My time again- do you work? I answered.

He left the room for a few after that. He came back asked for the documents that are being submitted. I gave him all the docs- I had originals and copies of everything. He flipped through gave us back original stubs and certificates, passports and said okay I am going to write pending in your passport and i said okay. He then said that's it! My husband and I said "that's it" right after each other. He said yes- you will receive a notice in the mail. I was so confused when I left because I expected to be asked more questions and I thought we would have gone through the documents submitted together. If I was thinking straight I would have asked him pending what? and directly asked if I was approved. I even forgot that he had originals for other documents in the package. I now have to figure out how to get it back.

Anyways- always know the name of the officer- ask for a card.
Don't leave the room as I did without directly asking what the hell happened here. Listen to what others say but don't expect to have the same question/answer interview as others because you will be caught off guard and when you gain composure- it's going to be too late.

I thought I would have known the outcome right there and then. From what I've been reading, you might get a letter saying congrats- you might get a letter requesting another interview- if it's "your" day, you'll get a stamp in your passport and the GC in the mail.

I guess I'm just waiting to get something (anything) in the mail. From what I have seen online it could take any where from a month to.... (some people are still waiting).

I sympathize with you. There is nothing more depressing, then waiting for something, not even knowing what for you are waiting for.... :(

We are in the same boat. It has been almost 4 weeks since my interview day, I'm still waiting for the desician letter. Our DO does not stamp on passport anymore. On interview day, it took only 10 min, they did not even check any of my document, then I did ask her what kinda desician letter. She said mostly an approve letter because it seems fine for her. But I did not receive anything so far. Right now I can't wait anymore, so I made an info pass Nov 22 with my DO to see what's going on. If I got something during this period then I'll cancel the infopass, if I don't, then I'll go to my DO and update news here.

Unless they changed the stamp rule recently, I know someone who got her passport stamped in October!

USCIS is trying to abolish this passport stamping business to prevent fraud. This rule has not been implemented completely across all DO's. Some still stamp and some dont.
 
He said that it was going to write pending what in your passport? At the end did he answered you if you were approved or just that you going to receive a notice in the mail?

You just prompted me to look in my passport and it states "pending 245" from what I've been reading it should be worth the wait! Here is a little blurb on the meaning of Section 245- there are many parts to this law such as 245(i) but hopefully he meant just "245".

Adjustment of Status

Adjustment of status entered our immigration law in 1952 with the then newly codified Immigration and Nationality Act (INA), as section 245, 8 U.S.C. § 1255. It gave the Attorney General discretion to adjust to permanent residence the status of those already admitted to the United States as bona fide nonimmigrants if they were immediately eligible for an immigrant visa. Until then, such persons had to leave the United States, obtain an immigrant visa at a U.S. consular or diplomatic post abroad, and return for inspection and admission. As a matter of discretion, some of those applicants were permitted “pre-examination,” a procedure that allowed them to get their immigrant visa in Canada, and their eligibility for readmission checked before they left the United States. While pre-examination eased the hardship for individuals, it caused a substantial expenditure of resources by the Justice and State departments.

Looks like if we didn't have Section 245- we would have been on a plane heading home. I'd rather wait right here!
Could this be the reason behind the stamp/no stamp at the interview??
 
I was telling my hus that some how I think that when the agent left the room that he was listening or watching us. I don't know why- but I get the feeling that's what happened.

Did anyone else have the same "leave the room" experience?
 
I think that just mean that your adjustment of status is still pending. The adjustment of status is base in the section 245. The 245(i) doesn't and won't apply to you.

Yes, I had same experience. We were left alone for full 10 minutes. I had a thought there must been some hidden cameras in a room, or tape recorder, or something.
 
Let me start recording my dates.

09/2005- Received interview letter
11/10/2005- Interviewed @ Garden City
11/12/2005- Received letter to do fingerprinting on Nov 25th at 8:00am. Guess I won't be going anywhere for Thanksgiving.

we have reversed situation. My interview is set on 4/19/06 at GC and my I-485 (FBI name check) finger prints is set on 11/28, the money right after thnxgiving.
I asked around, some of them say that the fbi name checks normally takes about 1-2 months to complete, and then send to the USCIS. so hopefully mine will get done before my interview, i have been waiting for 2 and half yrs.

Finally

I have been patiently waiting since my interview in November and FINALLY my case has been approved!!!! The best part is on the welcome letter it states that my card will expire in 10 years-yipppeeee!!!!
