First DUI on H1B Visa: What Are the Legal, Immigration, and Job Implications?

I was charged with Aggravated DUI in New Hampshire and I’m terrified about what this means for my future, especially my immigration status.
I am on my H1B Visa, Working as a Data Scientist for more than 2 years.
On June 8, 2025, in Portsmouth, NH, I was charged with:
Aggravated DUI (Misdemeanor A)
Lane Control Violation (Traffic)


I was released on personal recognizance. Conditions include:
  • No excessive alcohol or drug use
  • Mandatory court appearances
  • Must report any change of address
  • Repay $60 bail commissioner fee (I was not found indigent)
There's also an Administrative License Suspension (ALS) in place because I either refused or failed a chemical test. The suspension becomes effective 30 days post-arrest unless I request a hearing with the NH Dept. of Safety I was informed of this right.


Update:
We’ve received all evidence from the State Police. My criminal defense attorney says a conviction for Aggravated DUI is very likely and it’s going to be very hard to fight this case. That hit me hard.
Right now, I feel overwhelmed and unsure what to do.
More than anything, I’m deeply worried about how this might affect my immigration status, both now and long term.


Questions : I’m looking for guidance on:
  • How will this charge or conviction impact my current visa or future adjustment of status?
  • What can I do right now to protect myself legally and personally?
  • Is there any realistic path to rebuild from this?
  • Could this make me inadmissible or deportable under U.S. immigration law?
  • Would completing counseling, or community service help in immigration proceedings later on?
  • If I leave the country (e.g., for a visa stamping), could I be denied reentry?
  • Considering recent ICE actions and threats is there a real chance I could be detained or removed soon?
  • I understand I made a mistake this is my first DUI. As a first-time offender, do I still have a chance to avoid the worst consequences?
  • Will this DUI charge or potential conviction have an impact on my current job or career?
Even if the answers are tough, I’d rather know. I want to take the right steps now not just hope for the best. Any insight especially immigration or DUI attorneys I’d be incredibly grateful.
