First Application after 2 years.

it's been 20 months since I'm married to a USC. I couldn't file any papers yet due to some economic problems. I also couldn't find a financial sponsor for a while. Hopefully I'm thinking about filing my papers in this month, but before that I want to ask couple questions.

1- If I apply to green card first time after 2 years, is it possible to get a 10 years green card directly ?

2- Do I have to take more evidence to the interview since it's been over 2 years ?

3- If me and my suppose have no incomes how can I apply to a green card ?

You mean after you've been married for 2 years? Yes.

Well, I guess it's reasonable to expect more evidence if you've been married for a while.

Regarding your answer to question 1, I do not think you will be able to obtain the 10-year card (permanent residency) without applying for the 2-year card first (temporary residency). The I-751 application (10-year card) is to remove the temporary residency of your status.

So this is what I understand by that. Even though I've been married for over 2 years, at first I will have to get 2 years conditional green card, and I will have to wait 2 more years to remove the conditions. Is that right ? or I can apply for 10 years green card right after I get the 2 year conditional one ? By the way thank you for replies.

No, this is incorrect. If you've been married for over 2 years, they will almost always give you non-conditional permanent residency.

If you're already married for at least 2 years at the time of the interview, you're supposed to directly get a 10-year card (if you're approved, of course).

So you don't need to apply after your 2-year anniversary; if you apply after 22 months of marriage you'll definitely reach the 2-year anniversary before the interview.
