Hi friends,

My I-140 is approved under EB2(with labor substituion) on 23rd from TSC. So first question(doubt) I got in my mind was it approved under EB2 category? Is there a chance USCIS(TSC) may have approved under EB3 category becuase I have 3 year engineering degree? Offcourse time will tell that once I receive the hard copy(may be after 3 weeks) from my attorney. Will such thing like applied in EB2 and got approved in EB3 kind ever happend before? Any one know?

Okay second thing I will be looking at you the great guies for advise is that, I have to transfer to the company B for which I got my I-140 approval. But I am right now in 8th year extension with company A(labor PD:03/05/2006) and I-140 pending due to RFE. I have no choice but to shift to company B as the PD is 01/26/2004 and EB2 category.

Here the big question is how do I get my H1B get transferred? Presently I have hardly left with 4 months of 8th year H1 with company A.

What are the options available if I were to go for transfer to company B?

I truly appreciate your time and valuable suggestion in this regard? It helps me a lot to make a final decision how I should move to company B without any troubles down the road during I-485 stage?

What are the other risks at I-485 stage if I had to transfer to company B?

I-140 Receipt

Your I-140 receipt notice tells you if your application was filed in EB2 or EB3. If your receipt shows 203(b)(3)(A) (ii) then it is EB2. If it shows 203(b)(3)(A)(iii) then it is EB3. As for other questions, I do not know the answers.
