Dear all,

My I-485 applciation was pending at Phoenix, AZ. I moved to raleigh and sent Phoenix office change of address.

I then got fingerprinting notice (APRIL 20) for FBI at arizona address. So I again sent another letter (April 25) indictaing change of address and atatched the appointment and also indicated that address has changed and reshedule my appointment. I have signed receipt from INS officer receiving the mail, date and time at arizona from postal service.

I go to raleigh office and they tell me that the I-485 is still at arizona office (July 30). 84 days already passed and so I gave the fingerprints at raleigh office for FBI check. The INS person at raleigh told me that the fingerprints are valid for 15 months (I gave a set of fingerprints in phoenix on June 10, 2003) and my application is still pending and no problems so far.

Now WILL MY I-485 be rejected because phoenix never changed my address and never rescheduled my appointment after mailed requests and I gave finger printing at raleigh after 84 days?. How can I do damage control ? I am planning to go to the phoenix office in person and explaining the situation to get it corrected.

My application is based on marriage to amrican citizen. If my I-485 gets denied can I reapply since I am married to a citizen? If not what else I can do. Right now I am in an EAD and looking forward to join a new job in a month..PLEASE HELP..

Since you were able to do your FP at Raleigh office, you shud be ok. If the matter of "84 days being passed" was a concern, you would've known it by now. So, dont worry.
What I would suggest is to write a formal letter explaining all these to the Service Center where your I485 is pending. Plus, you may also check with FBI about the status of FP/name check to make sure your case is being proceeded.
