Fingerprinting notice received. Need advice

Hi all,

Thanks for maintaining such an active and informational forum. I have been a silent reader for some time now.

I received my fingerpinting notice on saturday, with appointment date on Feb'8th. Iam single and i wish to get married before i get my GC.

My lawyer suggested, sending a letter to INS to get a later appointment date (after 4-5 months). Will this cause any problems. Also, does this mean my I140 approaval will be delayed ?

Has anyone been in similar boat as me, and have done something differnt.

Please suggest..

My details:
EB2 RIR Labor filed Apr2001.
Labor approval: Feb 2004.
Concurrent I140 & 485 filed: May 2004
Finger Printing notice recvd: 01/29/2005

Have you seen any LUD changes before you received your Fingerprinting notice.
 
I am just giving my 2 cents worth - common sense approach.

As you have filed 485, you can not control the process. However, getting the FP will not accelerate the 140 approval or the 485. But as your PD is Apr 2000 and EB2, you are the most qualified guy for getting an immediate 140 and 485 approval.

Under these circumstances, if you wish to get married and get your spouse to US immediately and file 485, her process will speed up.

So sure, if you want to get married and add her and defer the FP ( you do not control the new FP date - it can come in 15 days - Then what ? )
that is fine. Logically, they will not approve 485 without FP results. So you can defer FP.

But if u take FP, most likley you will get 140 and 485 approved within a week as your PD is 2000.

Choice is yours !!
