Fingerprint Delay Issues - PD Current - Gurus please help!!

EB3 - Other countries.
PD - Aug 8, 2001 (became current on 07/01/06)
2nd FP - 4/12/05 (expired)
I-140 approved Mar 2004, 2EADs and APs approved, EAD extn now pending
FBI namecheck completed 8/2005 (found thru Congressman Garry Miller).
Dependents are spouse and 3 kids.

INS responded to my attorney's 3rd inquiry 2 weeks ago by saying,

"Both I-485 applicant’s fingerprints have expired. You will be mailed a fingerprint appointment when the ASC in your area has appointments available. Once the fingerprints clear, the files will be processed."

I am afraid that ASC may delay it too long and dates may go backwards. I have not received any notice or appointment yet.

My questions are:

1. Is there any way I can call some agency (USCIS or ASC) and request an early appointment or do I have to wait until I get a notice. From USCIS response it looks like that there may be a long delay before appointment is issued. I also read on some web sites that the ASC system that issues appointments is completely screwed up and it drops some people for a very long time due to system issues.

2. Are there any third party agency that take finger prints on behalf of ASC for I-485 for a payment? Does USCIS allow or accept that?

I have some extreme family situations abroad and need to travel. My spouse and kids do not have APs at this time and we are all waiting for GC as it seemed very close. Has any one gone thru this situation before with fingerprints? Please advise and help!
 
Looks like we are in the same boat. I also got the same response today from my local Congressman that our Fingerprints have expried and will receive a notice.
Here are my details.

EB3: PD Nov 2000 (Current since Mar 1st 06)
RD: I-140 and I-485 at TSC in June 2004
140 and 485 transferred to Philadelphia local office: July 2004
After several tries the file was transferred to VSC in July '06
140 approved last week and currently waiting for Finger print notice :mad:

First FP in Oct 2004.
 
They usually expire in 15 months. so, I would say - Jan '06.
I believe my name check is complete long back. How long does it take once the FP is given to approve the GC ?. I hope they dont initiate the name check again with the new FP's.

Namecheck has no connections with FP.

Contact Service Center again & request for FP.

ASC does not take calls. USCIS says they don't schedule appointments, it's ASC or their system that schedules appointemnt? Can you plesae explain who to call for scheduling? Any number?

I tried calling the USCIS to schedule FP's but no luck. I was told that I just have to wait...... :(
 
Waiting for Finger Print Notice

I am also in the same boat. My FP expired on 07/07/2006. I haven't got the FP notice yet. When I called INS, she said, I need to wait. I don't know what else I can do. I may try to get the appointment with ASC.

I-140 approved on March 2005
Name check and I-485 pending
 
I received my fingerprint notice today i.e. 8/5/06. Of course I kept sending inquiries to USCIS myself via emails, thru attorney and thru congressman relentlessly. Those whose PD is current and they believe that their name check is completed and their FPs are expired, keep bugging USCIS until you get the fingerprint notice. I think it worked so far in my case.
 
I called the USCIS but no luck in setting up the appointment for FP's. I got the FP notice last Saturday and am supposed to go this Thursday.
