I will be applying via I-130 for a marriage based green card as soon as I am married in the next 3 months.
Situation:
- My fiancée is currently working as a Nurse while she finishes her Nurse Practitioner program in the next 3 months.
- She is contemplating quitting her job in the near future so that we can enjoy some travel time before starting the next leg up in her career.
- Her 2022 tax return (soon to be filed) more than supports financial sponsorship requirements, however, we don't want the fact that she may not be employed during the application process to jeopardize the application.
I have come to learn that we may be able to file an I-864W exemption based on her having 40 quarters of employment which sounds to me like it would be a non-issue if she is not employed during the period the application is being processed.
Does this basically mean that there would be no financial sponsorship requirements?
