Finally I got Approval for I-140 from VSC

After getting denied initially (two years ago).
I appealed and case is transferred to Adminstrative appeals office. My case is approved by the AAO and sent back to INS two weeks ago. And now INS approved my i-140.

How do you know yr case is approved by AAO.
Because my case has also been sent back to VSC and i do not know how to find whether it has been approved by AAO.
Can u help me?

I am getting the message from VSC saying that yr case has been received back from AAO, if any further action is appropriate, will notify you when it is taken.
 
I waited about three weeks after AAO sent the decision to INS.

did you received the decision copy from AAO?
What does it say?
Why is that your case went to AAO?
 
Yes..I received decision copy from AAO. The copy says,
'This is the decision taken in yr case. All the documents were sent to the office which originally decided yr case. Please contact them for further queries.'

My I140 was denied because of col 16...i.e. INS wanted more explanation on B.S.+9 years. It was applied under EB3 NON-RIR.
 
It also says, 'if you feel that the decision taken is inappropriate you can appeal again'
 
your case is also in similar lines as mine. INS questioned my 5 years experience. But AAO approved
and i got the approval.

Don't worry... you are going to get approval. Let us know the good news !!!!
 
What exactly was given under decision in AAO copy.
I would like to know the decision wordings given by AAO in yr copy. Does it clearly say approved?
Please let me know

When my company called VSC, they were told that the case is pending and are waiting recommendation from AAO
 
It is a 4 pages decision.

I will highlight some important points.

"This is the decision in your case. All documents have been returned to the ofiice(INS) that originally decided your case. Any furhter inquiry must be made to that office....

.....The employment-based immigrant visa petition was denied by the director, Vermont Service Center, and is now before Associate Commissioner for Examinations on appeal. The decision of the director will be withdrawn and the petition will be remanded for further action and consideration...

.... on appeal, the petetioner submits a new letter from ....., verifying beneficiary's employment there from .... to ...., as claimed on the beneficiary's form ETA-750B Statement of qualifications. This letter overcomes the only stated ground of denial, and therefore the director's denial cannot withstand.... "

this went on for about four pages. AAO will send one copy to INS , second copy to Attorney and third copy to your company. Check with your company or your attorney whether they recieved this decision.

When i asked my company, they sent only one page, which says
as follows. Does yr first page match with my first page, if so, then
i can ask my company to send me the rest of the pages. Thank you so much for yr reply. If you can let me know, so that i can talk to my company accordingly.

If you believe the law was inappropriately applied or the analysis used in reaching the decision was inconsistent with the information provided or with precedent decisions, you may file a motion to reconsider....

Any motion must be filed with the office which originally decided your case alongwith a fee of $110 as required under 8 C.F.R. 103.7

I think I had a strong case of NIW. I have 30 publications, one natinal reward from my homecountry. I have been working on the projects funded by National Science Foundation and National Institutes of Health at the leading universities like Johns Hopkins, and I provided a lot more materials than usual (for example, I had 12 reference letters from Scientists at EPA, NASA, Johns Hopkins, Georgia Tech, etc). However, my current lawyer still could not help me to get it through. My case was still denied after the request for extra evdence. The reason is: the evdence fails to show the national interests would be adversly affected if the bebeficiary were required a labor certification.
