Hi Friends
I am a silent observer of this forum ....never posted any comments...but finally when I saw my approval I wanted to share it with everyone as every approval that I used to see close to my ND used to excite me....

Here is my case started with GC processing in Jan 2001
got labor approval in Jan 2002 filed for I-140 got that approves in July 2002...filed my and my wife's I485 in Sep and was received by INS in 5 days got 2 EAD'S and one AP till now....interesting thing was 7 months after after filing I-485 I lost my job and moved from Houston, Tx to Chicago was un-employed for almost 6 months got a job in Chicago sent my AC21 and AR-11 as required and finally on 14th July it was my and wife's day....I wish all of you out there good luck.

I was almost expecting a RFE but fortunately it didn’t happen….even though I moved to Chicago my case was still with Texas INS….got my finger printed done in Jan 2004.

A few questions:
1. What's AC21 in your case? Must everybody who changes jobs file AC21?
2. Where did you get fingerprint notice, TSC or NSC while your case remained in TSC?

Ac21 is the 180 day portablity letter that you need to inform to INS when you change job ....the requirement i understand for it is that your job roles and salary should be in line with what your labour petion says....there can de a slight deviation but not like apple and oranges.....my finger print notice was sent to me by NSC and for once i thought my case has been transfered to NSC but i verified that it was still with TSC the only reason NSC sent me finger print is because i had reported AR11(CHANGE OF ADDRESS WHEN I MOVED TO CHICAGO WITHIN THE FIRTS 10 DAYS)

I don't think Salary is an issue for using AC 21 as long as we get atleast what ever is specified in LC. My opinion is it is the Job Skill Set & Title that matters for using AC 21 because we have many people on this forum that got approved with too high salary where the Job Title & Skill Set is same w.r.t. LC

Yes you are right as long as the difference is not drastic i.e if your labor said making 110k and now you make 40k that will cause issues if you are unfortunate to get a rfe as your new salary should not be below the minimum prevaling wages....I was also in the same boat as i had a 20% salary reduction but still was above the red line..... if you are lucky and rfe dosent come in you will still slip in and i actually know some friends who were in that boat ...never got rfe's ...all went through easily....its problem only when you are issued rfes or called in for 485 interviews.....other trick is in your ac21 letter not to mention your salary if it its drastically less and specify more about the similarity in you job responsibility.....and again i am not a guru but this is based on what i have been able to collect...
