Hi Sufferers

Attack is the best way to defend our interests

If we try to highlight our issues and expect that INS will
solve our problems we are expecting GOD to come down and help us.

Instead we have to attack INS but HOW ?

We as a group have to file a case against INS.

Claiming that INS because of its inefficiency is delaying justice.

Issuance of guidelines is an internal problem of INS. But the law
is clear that after 180 days a employee can change his EMPLOYER.

For most of us we have gone past 180 days deadline. It is highly
improper for INS in keeping hold of our 485.

Do we have a case ? (That is my big question)

We need to find a common lawyer who can fight for us.
(will sufferers come together and pay some $$. next big question)
We may have to "PROVE" INS is holding these cases.
We may have to "PROVE" our sufferings.
We cant expect our 485s to be cleared in near future.(SAME AS NOW)
OR
INS can really wakeup and work on our cases.(WHAT WE WANT)
OR
we can get some official INS answer.

You are right about doing something ragarding frustrating wait while people who filed months later are getting approvals. First thing we need to do is to form a group consisting of those who really want to do something instead of just waiting. I will be first to volunteer.

Only VSC is holding our cases. CSC is issuing RFE for these kind of cases. There is no uniformity among these service centers. This could be a good item to go to court and force VSC to follow other centers. It is really vry frustrating. I also suggested sometime back to take action like this. There are nearly 50 people who are suffering. Even each one contribute say $1000, it should be a quite good amount. Am I right?
    I am ready to contribute and cooperate with you.

Friends, I like the idea very much and count me in i am wiling to spend my time for this UNACCEPTABLE and IRRESPONSIBLE method of VSC putting uor cases on hold.....

May be Carl Shusterman or Rajeev Khanna or Cyrus Mehta ???? We can ask them if they are interested ????

As I have already said we must make sure that we have
a case, I dont know any Lawyer, I need
someone who has strong links with any of the Lawyers to
verify the same. As we all see there is a strong
support to this kind of idea, More people will join
once this idea picks up some momentum. $$ will not be
a problem when more people join.

Any volunteer. Suggestions are welcome.

Here is the list of people whose 485 is either on Hold/under review beacuase of the name change. Hope everybody will join in this effort. I strongly feel that going to the court is the best to way to solve our problem. These service centers are very inconsistent in handling this type of cases.

Hi All,
    I strongly feel that taking VSC to the court is the best solution to our problem. Even if you apply pro-active I-140, it is going to take anywhere between 8 to 10 months to get the I-485 final approval. I believe that we have following points strongly in our favour to gog to court.

    1. No clear cut policy with INS. CSC sends RFE for our type of cases whereas VSC puts on hold.
    2. Those who have applied after us are being approved.
    3. Not implementing the law even 6 month after its enactment. Also we do not know when it will be implemented.
    4. Implementing the law in bits and pieces.

    Can somebody who has good contact with lawyers lead this effort. Sure, I will fully support with money and time.

     Does anybody know the lawyer who own the case for someone whose I-140 was denied in EB2 because of his qualification. This has benefited lot BS+5 years people. May be we can contact the same lawyer. I will try to find about him.

      We will have to do something apart from sending letters to senators.

         Let us all unite together.
