I am a Permanent Resident and I need to fill up form N-400, but my wife is out of status. I am forced to tell USCIS her immigration status on this form, but I am afraid to do so. Can anyone tell me what do I have to do in this case?

Thanks,

Hi,
I came across your thread about filling the N400 form with wife out of status. I am in the same situation right now. What did you fill there and have you gone for the interview. Your response will greatly appreciated.

You have to state the truth. I had the same concerns when I filed mine about a month ago. Sought advice from a lawyer and forums like these with the same situation. Everyone said to tell the truth. We dont have a choice so in my case I put "B2 Visitor Overstay". I just completed my FP and I am now waiting for interview letter.

All the best in your interview. I'll be mailing my application in about 4 weeks. Kindly post a reply to know how your interview goes. All the best again :D

it depends from case to case...if your spouse came in legally but overstayed it is something which uscis is going to forgive and it will not affect ur application for citizenship...

Look around in this forum in the 485 section, you will finds loads of information as to how u should proceed....

hope this helps.
