Filling another labor certification with another employer in same state

Hi

Can any body answer my question.?

Actually i am working on client site in OH and my employer is in texas. I filled my labor certification with one comapny which exists in Ohio and it got approved but due to some problems i don't want to file 140 with that company. My employer (which is in Texas) is filling my labor from Ohio .Is there any problem if i file second labor from same state because first was already approved from OH only.

Yes. I believe it is permissible to have 2 LCs pending at the same SESA at the same time as long as there are 2 different companys. Just be aware that there could be some confusion and it is possible that the one company will become aware of the other's filing. That may not make the company very happy.

As you are saying that first company will come to know about the LC filling from second comapny but all these problems in case LCs are pending right. But my first labor is cleared and i am not filling I-140 with first company due to some problems and filling Lc with second company. Means if first labor is cleared then there is no prblem at all am i right?

Well the answer goes like this:
First company cannot come to know about your LC filing unless you/your lawyer/your other company confirms it - doesn't matter pending or otherwise. (Please be aware - there is something called disclosure data - which is published after couple of years - I think.).

If I got you right then I think you have one LC done through one company and you are going for second through some other company. Your apprehension is if it can cause any problem? If my understanding is right then answer would be - It will not cause any problems ay any stage.

You are right. I got my LC cleared from one company which is giving me hard time to file second stage. Now i am planning to file a new LC with my own company. Lets see how it goes and how much time it takes. Thanks for ur help.
