Fill PERM during Layoff?

hi,

I am in non-RIR LC application ,and considering to fill PERM(identical to keep my prority day). But my Company(an international one) is laying off people(possible a couple thousands in US).

Can I still fill perm? Thank you very much

PERM and layoffs

It depends. If the company is laying off workers with similar jobs, the answer is NO unless your position has been offered to the other workers and they all turned it down. If no position laid off is similar to yours, you can file PERM. To be safe, wait 6 months as this is the waiting time needed for the layoffs no longer to be an issue in this context and you can move forward with PERM with no regards to the layoffs. It specifies 6 months on the PERM application form.
