Filing & travel related question

Here is my background?

Married to a citizen hence eligible for applying in 3 yrs. All throughout I have maintained my status.

My question is:
1) My 3 yrs are up in march 28th 2007, so technically I can apply after dec 28th, 06. Currently I am in india since august 21 and planning on coming back to us on dec 20th. Now can I apply right after coming to us or do I have to wait for 90 days before applying ?

2) Can I travel after filing my paperwork?

As long as you do not stay out of the country for more than 6 months, you can apply right away.

Yes, you can certainly travel immediately after filing N-400 application but you got to realize that you will have to be back for your FP (which is typically within 30 to 45 days of PD), interview and oath.

You'd only have to wait the additional 90 days if you change district in which you reside. So, if you're returning to the same address you maintained while you were out of country, you can apply immediately.
 
Count the 90 days (not three months) carefully, and then wait a few more days to make sure. There are folks on this list who mis-counted by 1 day and had their application returned.

The trick when travelling is that you need to find out when USCIS notices arrive and be able to show up when they ask you to (and, of course, you can't break the "residence" or "presence" rules)
