Filing tomorrow....need help

Thanks everyone for your help in my earlier post. My wife (USC) is filing my petition. I am on H1B visa (valida till Sept 2008). Please help on the following issues.

1. Do I need to file I-131 to travel abroad? As per I-485 instructions.

Exceptions to filing I-131.
If you are an H, L,V, or K3/K4 nonimmigrant whocontinues to maintain his or her status, you may travel ona valid H, L, V or K3/K4 visa without obtaining advanceparole.


2. My wife is waiting to get her passport (name change after marriage). Should I wait for her passport or use her Citizenship Certificate as the proof of citizenship for I-130.

1. You answered your own question. You can travel on a valid H1B because it allows "dual intent." You do not need AP.

2. Citizenship Certificate should be enough (see 5B of I-130 instruction at top of page 2).
 
Thanks for your help. I am submitting I-130, 485, 865 and 865A. Can anyone tell me if I need to submit my G325A 2 times- once along with I-130 and once along with I-485.

Pls read instructions before you ask these questions...
 
I assume you mean 864 and 864A. Anyway, I do not think that you have to include your G325A with both I-130 and I-485 when you file concurrently since I think they end up at the same place (I could be wrong about that [and I was! :o ]). I did include two copies with my filing, however, because I did not see any harm in including an extra copy. It is easy to print two copies if you use the fillable form.

I-130 = two sets of G-325A (one from sponsor + one from applicant)
I-485 = one set of G-325A (from applicant)

3 sets go with the pacakge to the lockbox. Whether it is needed or not is a different question, but it is specifically mentioned in the instructions. After the package reaches the NBC, the I-130 goes to the SC and the I-485 goes to the DO

Don't worry, I think I sent one set less than required and I didn't have any problems. Yet. I mean, they have got the information, so they could just photocopy it while preprocessing, right?
 
Yeah.. you never know. But if it helps, I have never seen anyone here even get an RFE yet, just because they didn't send the right amount of G-325As sets. :)
