Hello everyone, quick question...I'm filing for my wife son who is over 21, with a current PD. My wife and I filed our taxes separately, my question is, does anyone think this will cause any harm when i mail in the support of affidavit next week, OR with the immigration process. Thank you for your help in advance

Hi malakai,

For taxes , you are married but filing separately is fine. It should be OK with immigration too. My spouse and I did the same thing, never once was it brought up in our AOS interview.

One of our friends who was going thru AOS was questioned by the immigration officer on why did they file separately even though they were married. Our friends told them, they were advised by the accountant to do so. Immigration officer said its not a big deal, he was just asking out of curiosity and wanted to see if that had some tax advantages!

oh, ok because i filed head of household and claim my daughter as advised by my accountant, and my wife filed head of household and claim our son. So guess i'm hoping that's not a problem.
