filing taxes

Have had my GC for 14 years.
In the beginning worked for a company which took taxes out of my paychecks.
Did not file taxes.
I am now filing for citizenship and wanted to file for those years.
Turns out the company never paid in my taxes and I never received W-2 forms.
The company is now out of business.
Can I risk having to pay taxes all over again?

I guess it is hard to understand how you could have 'missed' filing your taxes for 14 years .... I would think that you knew that whatever your employer deducts or does not deduct from your paycheck does not excuse from the responsibility to file your taxes.

Either way ... filing your taxes is important. So a) see with an accountant how you can clean up as much as possible. My guess is that you were setup to be employed illegally if your employer did not send you a W2. b) Play by the rules as of now and consider not petition for citizenship before 2011 so that you can document that you paid your taxes in the five years before your petition. When you petition consult with a lawyer to have somebody look at the actual details of your tax history and how this may be viewed by the USCIS.

Do you have pay stubs which indicate that taxes were taken out of your paycheck? If you can find your old paystub get the following information.

Company Name
Address
EIN (Employer Identification Number)

and call IRS at (800) 829-1040 and tell them that you did not receive W2 for the particular year. IRS will then send you Form 4852 (Substitute for Form W-2), which you can use instead of a W2 and file your taxes.

Also be sure to send the Form 4852 to your local Social Security Administration office, so you can get proper credit for the social security taxes paid.
