Filing second I-140, first I-140 is still pending

I have an approved labor with pripority date September 2006 (EB2). My I-140 is currently pending at NSC. My company is now offering me a Substitution Labor with pripority date of March 2005 (EB2).


  • Can file multiple I-140 with the same company.

  • If I do file a new I-140 with the substituted labor and suppose the priority dates of EB2 category move forward in next few months, so that the priority date of the substituted labor becomes current. Then can I apply for I-485, with my I-140 still pending.
