Filing LC from two different state (same employer) together - Please advise

My labor application is stuck at Phily DOL, 4 months have passed since lawyer rebutted NOF.

Today I spoke to my employer about this and he is ready to file a new labor application from state where head office is that is NJ.

But I don't want to abandon my exisiting application at Phily DOL for two reasons:

1) It may get approved any day and I have waited on this for 3 years. ( # Lssd got approved in similar case )

2) I'm already in 7th year extension and I need this pending LC to get my 8th year extension, if it does not get approved.

Is it okay to file new LC from NJ while one is pending at Phily DOL and getting both of them processed together ?

Sure.

But keep in mind that NJ SESA is currently processing Jan 2002. Two year wait for RIR cases.

I know anout NJ RIR but have no other option. My Lawyer and employer have agreed that they will appeal my Phily labor denial to BALCA, in case of denial ( # My company has 15 LC approval from Phily region without any problem ) but that takes long time.

For this reason I think they should file another labor from NJ.

I have one more question for this forum:

My Phily labor was filed non-RIR on June 20, 2001, is there any way I can keep this priority date ? ( Now everything is current but there may be backlog if PERM gets launched and CIS starts approving 140/485 cases within 90 days time frame )

I am not able to understand your question.

If/when you apply for I-485, PD is always reserverd depending upon LC RD at local SESA.

My question is:

If my Phily DOL gets rejected and I use NJ LC to file for 140/485 is there any way I can keep Phily LC SWA RD as my PD.
 
You are trying for "Grand-Parenting" regarding your LC application.

I doubt it that you will be able to use RD of Philly (incase that is rejected/denied) while applying for AOS with NJ LC.

But that won't give you much benefit in terms of time. Definitely you'll have more choices rather than being stuck with one employer !
