Filing I485 - 8th year H1B Extention receipt notice still not received, pl. help

Hi All,
My Labor and I-140 are approved ready to file I485. But my H1B expired last month, my employer already filed 8th year extension. It's in California Service Center (CSC). It's been 45 day's but still I didn't get my receipt notice. Since now all 485 are current till August 17th, can I file my I485 with receipt notice once I get one OR can I file with out receipt notice including a cover letter OR do I have to wait till I get approval? My wife already got the receipt notice 30 day's back (H4B). How long will it take to get the receipt notice in CSC? Every thing is ready to post just waiting fpr H1B receipt notice.

I did the following

I have the same case:
H-1 extension ( 3 year extension after 6th year on approved 140) is in process .
Just received hard copy of approved 797 notice only on July 20th 2007

As per lawyers advice we filed the 486/131/765 along with a receipt notice of the h-1 on July 02 2007 (showing that the h-1 is in process ).

He said that the worst that would happen is that they may send the application back stating insufficient documents.

Well as of now the 485 was delivered on July 2nd and the good news is that we have not received anything back.

Hence I would advice not to waste time and send in your documents ASAP.

You have the receipt notice to apply but in my case it's been 45 day's and still didn't get my receipt notice.

Any way, yesterday my wife's H4B is approved waiting for approval notice. Since I don't have my receipt notice no way to check my status other than to expect that my H1B is also approved and to wait 2 - 3 day's to get the approval notice and then to file 485.
