Filing I-485

Hi All,
Here I am explaining my situations for I-485.

I had filed my I-140 from Company 'A' ,
Company 'A' laid me off before I get my I-140 approval.

Once I got terminated from A, I got job offer from Company 'B' .
Few months after joining company 'B' , I got my I-140 approved and Company 'A' sent that original approval notice to me .

Now lawyer from Company 'B' is saying that he can file my I-485 on the basis of I-140 approval from employer 'A'.
Lawyer is saying that he is very much confident about this.

I want to know from all you people ..is it possible ? How much risk involved in it ? Is It worth giving a try for it ?

Please suggest me ..I really Appriciate your help ..

Strange that you don't seem confident of your lawyer's (who is paid to know what he is talking about) advise, and instead prefer the solicit advise from common lay people.

For what it is worth your lawyer is right and there are not too many risks. Worst case scenario for you would be speedy approval of 485 within 180 days, which is extremely remote, but other than that you should be okay!

1. Why didn't you file I-140 and I-485 together with A?
2. Your attorney is trying to play some trick to use A's I-140. It's worth a try. You lost nothing to little.
3. Try to ask B start LC for you, in case the I-485 denied.

I was thinking that my new employer 'B' do not want to spent money on my GC case and he is forcing lawyer to say what he(my Emploery) want to say ..and save money .

My previous employers 'A' lawyer did not want to file both I-140 & I-485 together again because of money part involved in filing fees etc ..

I started thinking that lawyers are biased towards employers becasue they are their main clients ..so whatever employer wants to say ..he will convey the LAwyer and lawyer will explain same thing to us with "Rules & Regulations" term ..

But anyway thanks for your replies ..I am thinking now that I should give a try now ..

Technically a lawyer who is representing you for 485 is YOUR lawyer and not your companies, regardless of the fact that your company is paying him.

He has to look out for your best interest and not the companies. If at some point of time the two interests are diverging from each other, he will have to resolve the conflict of interest on his own and if he can't deal with it, he needs to give up one of his clients! As simple as that, if he still screws with you, you can very easily sue him and get him disbared.

As far as 485 application is concerned, AGAIN there is no loss in applying for the 485 through company B based up on an approved 140 from company A. The only fly in the ointment would be if your case is approved with 180 days as explained above.

So don't sweat it too much. If you are not confident about your lawyer's capabilities, you can always go to another lawyer for a referal. Pay for it out of your own pocket (a few hundred dollars), but it will buy you a lot of peace of mind.
